WASHINGTON, D.C. – Today, U.S. Congressman Paul A. Gosar, D.D.S. (AZ-04) released the following statement after a federal appeals court issued a nationwide stay blocking the implementation of the Environmental Protection Agency’s (EPA) Waters of the U.S. (WOTUS) rule resulting from a lawsuit filed by 13 states, including the state of Arizona:“As federal courts around the country continue to limit the Obama Administration’s lawless, overreaching regulations, the bureaucratic minions forcing these policies down our throats should take notice. No president or D.C. bureaucrat is above our Constitution. For the good of our country, I pray that this misguided effort to illegally push an ideologically-driven agenda, will continue to be thwarted by our judicial system. Furthermore, those who are knowingly violating the law to impose job-killing regulations by executive fiat should be held accountable. Today’s decision is another massive blow to an administration that continues to run roughshod over the rule of law and disregard our nation’s system of checks and balances.

“WOTUS is a job-killing, overreaching new regulation that would be a dream killer for future generations and result in significant job losses as well as considerable harm to our economy. This terribly flawed Washington mandate contradicts prior Supreme Court decisions and seeks to expand agency control over 60% of our country’s streams as well as millions of acres of wetlands that were previously non-jurisdictional. The fight to stop this regulation will not be easy, but I am committed to protecting the American people from this blatant executive water grab and will continue to fight this overreach at every opportunity.”

Background:

From the U.S. Circuit Court of Appeals for the Sixth Circuit: “A stay allows for a more deliberate determination whether this exercise of Executive power, enabled by Congress and explicated by the Supreme Court, is proper under the dictates of federal law.”

On March 25, 2014, the EPA and the Corps released a proposed rule that would assert Clean Water Act jurisdiction over nearly all areas with even the slightest of connections to water resources, including man-made conveyances.

On May 1, 2014, Congressman Gosar and 230 of his colleagues sent a letter to Gina McCarthy, Administrator of the EPA, and John M. McHugh, Secretary of the Army, urging them to withdraw the proposed rule. The full text of that letter can be found HERE.

On January 28, 2015, Congressman Gosar introduced H.R. 594, the Waters of the United States Regulatory Overreach Protection Act. This legislation has the support of 185 bipartisan cosponsors. Click HERE to read more about the Waters of the United States Regulatory Overreach Protection Act.

On May 12, 2015, the House passed H.R. 1732, the Regulatory Integrity Protection Act, by a vote of 261-155. This critical legislation requires the EPA and Corps of Engineers to formally withdraw the agencies’ proposed rule that would redefine WOTUS and any subsequent final rule. Congressman Gosar has also inserted funding riders into appropriations bills, blocked a democrat amendment that tried to strip one of his WOTUS riders and voted at least five different times for legislation that has passed the House to block WOTUS.  In July 2015, he berated EPA Administrator Gina McCarthy and submitted revelatory evidence into the Congressional Record from senior Army Corps of Engineer employees which expressed serious legal and scientific deficiencies with the final draft of the WOTUS rule.

More than 200 organizations and local municipalities have publicly declared their opposition to the proposed WOTUS rule.

On numerous occasions, EPA Administrator Gina McCarthy broke the law by lying to Congress in order to try and impose WOUTS by regulatory fiat. On September 11, 2015, Congressman Gosar introduced H.RES.417 to initiate impeachment proceedings against Administrator McCarthy for these crimes. “While the recent Ebola outbreak poses a real threat to the United States, the incompetence and indecisiveness of the CDC and the Obama Administration is just as dangerous. Yesterday, it was reported that Dallas nurse Amber Vinson, who recently was diagnosed with Ebola and cared for Thomas Duncan, checked with CDC before boarding a flight from Ohio to Texas after running a slight fever. The CDC cleared Vinson for travel and failed to prevent her from getting on a plane with more than 100 passengers and traveling halfway across the country.

“The protection of the American people is the most important role of our government. CDC Director Thomas Frieden has failed to lead and has shown gross incompetence in his actions or lack thereof to prevent the spread of Ebola domestically. We cannot afford such mistakes when American lives are at risk. That is why I am calling for the immediate resignation of Director Friedan. At this critical moment, we need leaders who will act boldly and with foresight to prevent the threat of Ebola from spreading. Americans deserve real leadership and accountability.”

Background:

Dear Friend,

I know there are a lot of questions surrounding the federal government shutdown, but I wanted to write you today and give you a little background to tell you what is going on here in Washington, D.C.

How We Got Here

It is the duty of Congress to pass an annual budget which would include 12 funding areas.  Both the U.S. House of Representatives and the Senate are supposed to pass the individual bills, and then both bodies come together, reconcile the differences, and send them to the President for his signature.  In the event that a full budget cannot be agreed upon by both bodies, Congress has historically relied on short-term fixes which keep the federal government operating under a temporary basis.

The latest of these budgets ran out on Monday and at midnight the federal government suspended operations for positions deemed non-essential.

My office is still running on a limited basis.  I am in D.C. attending meetings and briefings and taking votes to try to open up necessary services while maintaining the position that we can’t continue business as usual and move forward with Obamacare.

I was sent to D.C. to do the will of the people and you, the people, have asked me to stand my ground on your behalf.

Summary of Three Bills Passed and Sent to U.S. Senate

The House has sent the Senate three different versions of the legislation that would fund the federal government.  Here is a summary of each of those continuing resolutions:

Military Pay Protected by “Pay Our Military” Act

I was proud to vote for the Pay Our Military Act (H.R. 3210) prior to the government shutdown.

This bill protected the men and women of our armed forces from the shutdown by providing the money to pay the salaries and allowances to members of the Armed Forces (including active duty reserves and the Coast Guard) during any period in FY 2014 in which interim or full year appropriations bills are not in effect. Also, it provides the same authority to the Secretaries of Defense and Homeland Security to pay civilian employees and contractors engaged in support of the Armed Forces during the same period. This legislation was signed into law.

Miscellaneous Frequently Asked Questions

You may be wondering what happens to federal services during a federal shutdown.

You have probably noticed that the U.S. Postal Service has continued to deliver your mail.  They are not funded by the Congressional appropriations process.

Social security benefits, SNAP, and unemployment benefits will also continue.

Here are the answers for some of the most common questions via the Heritage Foundation (http://blog.heritage.org/2013/09/30/qa-what-happens-during-a-government-shutdown/)

Q: Would retirees and veterans get their benefit checks?

A: Yes, mandatory government payments such as Social Security and veterans’ benefits would continue to be paid. During a prior government shutdown in 1995, 80 percent of Social Security Administration employees kept working because they were considered “essential” to making benefit payments.

Q: Would national security be hurt by a shutdown?

A: No, national security, including the conduct of foreign relations by the President, is considered an essential function that would continue.

Q: Would food and drug safety be imperiled by a shutdown?

A: No, the federal government would continue to conduct testing and inspection of food, drugs, and hazardous materials, because these are considered essential for the safety of Americans.

Q: Would we still be able to travel?

A: Yes, the government has said during prior shutdowns that the air traffic control system and other transportation safety operations are essential to the safety of the country and would continue to operate. So air traffic controllers would keep directing air traffic at airports around the country, and you would continue to be searched by agents of the TSA when you board a flight.

Q: What happens to federal law enforcement activities?

A: During a shutdown, all federal law enforcement and border control functions continue to operate. So the FBI would continue to make arrests and conduct criminal investigations. The U.S. Border Patrol would continue to patrol the American borders. The federal Bureau of Prisons stays open, and convicted criminals are not released.

Q: Would there be any problems with the Federal Reserve and the Treasury Department’s supervision of our financial system during a shutdown?

A: No, all activities essential to preserving the money and banking system of the U.S., including borrowing and tax collection, would continue. So the IRS would keep on collecting the tax revenues that help pay for the operation of the federal government.

Q: What if there is a natural disaster like a hurricane during a government shutdown?

A: Emergency and disaster assistance are considered essential to protecting life and property, so federal disaster assistance continues during a government shutdown.

Politics of the Shutdown

This evening, the House voted to approve the following bills:

H.J. Res. 70 –  Open Our National Parks and Museum Act – this bill provides immediate funding for National Parks and Museums including Grand Canyon National Park, the National Gallery of Art, the World War II Memorial and the Holocaust Memorial Museum.

H.J. Res. 71 – Provide Local Funding for the District of Columbia Act – this bill would let the District of Columbia spend its local money.

H.J. Res. 72 – Honoring Our Promise to America’s Veterans Act – this bill ensures the VA can continue to operate and provide services, and guarantees veterans disability payments, the GI Bill, education training, and VA home loans will not be disrupted by the shutdown.

H.J. Res. 73 – Research for Lifesaving Cures Act – this bill ensures the National Institutes of Health can continue their work.

H.R. 3230 – Pay Our Guard and Reserve Act – this bill provides pay and allowances for military personnel in the reserve component who are in inactive status.

Even though these are common-sense solutions that will alleviate burdens of the shutdown, Majority Leader Reid and President Obama say they will not support them.

WASHINGTON, D.C. – Today, U.S. Congressman Paul Gosar, DDS (R-AZ) voted for the Conservation and Economic Growth Act (H.R.2578) a package of 14 Natural Resources Committee bills that will create new American jobs, grow the economy, and protect the environment.

“Each of these bills has one thing in common; they get the Federal Government out of the way of Arizona’s families and businesses. I represent rural Arizona and over the past year I have met with thousands of people in my district who have asked me to stop the unnecessary government intervention in their lives,” said Congressman Paul Gosar. 

“These bills allow our ranchers to prosper, permit our Border Patrol to better protect our border, and give states more power in utilizing resources to support public target ranges. Unnecessary federal regulations are stifling job creation and slowing down progress throughout Arizona. The Conservation and Economic Growth Act includes three particular pieces of legislation that address the priorities of rural Arizonans.  Congressman Gosar has long advocated for these bills, helping navigate them out of the House Natural Resources Committee.

1) The “Grazing Improvement Act of 2012” (Title XI) (H.R. 4234) which will improves and streamlines the process for renewing livestock grazing permits. Are more candidates for CD4 lurking out there? And is one of them the current Arizona Speaker of the House, Andy Tobin?

Sounds like it’s a possibility. At the end of today’s Republican Women of Prescott (RWOP) meeting, when the club’s President Pam Jones, was telling the ladies (and gentlemen) about next month’s meeting (Tuesday, May 22) she explained that all the Republican Congressional District 4 candidates would be attending. She named Sheriff Paul Babeu, Congressman Paul Gosar and AZ State Senator Ron Gould, as being confirmed for next month’s meeting.

Then Jones said, “There might also be another candidate. One that is said to be 98% certain to get in the race. I won’t tell you his name, but you all know who he is.”

Andy TobinShe also hinted that there might be a fifth candidate, but didn’t give any further information on who that possible person is.

Rumors have been swirling for months that Speaker Tobin might get into the Congressional District 4 race. As a matter of fact, at Saturday’s Republican County Caucus meeting, AZ Senator Lori Klein was in attendance to make a quasi-announcement of her own.

“I’m the Senator for LD6, and I actually live in Anthem,” Klein said. “Anthem is now part of your district. So, now, we’ve been hearing rumblings for a long time that Andy may run for Congress, and if so, there’s a House seat that’s open. I serve at the pleasure of your Senate President, who is really an outstanding guy, and it’s been a pleasure working for him. We’re in a battle right now to keep our budget lower, where it should be so that we don’t have a structural deficit of almost a billion dollars in 2015. So, we’re in an interesting battle, but our Senator, your Senator [Steve Pierce], has really been standing by us and conservatives in our caucus and holding the line. So, I’m trying to decide, I have a long history here, I have a cabin in Breezy Pines, so I’ve been up here quite a bit. I may run for the House in your district if Andy runs for Congress. So, that’s something that I’m exploring.”

When asked, Speaker Tobin said that he’s focused right now on this session in the Arizona House, especially on the budget.

Beyond that? “Hmmmm… no comment,” was Tobin’s reply.

Prescott Valley, Arizona–Today, Mayor Harvey Skoog and Vice-Mayor Patty Lasker, Town of Prescott Valley, announced their joint endorsement of Congressman Paul Gosar’s re-election to the newly created Fourth Congressional District. The Town of Prescott Valley is located in Arizona’s First District which Congressman Gosar currently represents but after redistricting will be in the new Fourth District.

Mayor Skoog was first elected as Mayor of Prescott Valley in 1993 and served through 1998. Harvey later ran again and won the mayoral seat in November 2004 and has since won re-election twice. In July 2010 Mayor Skoog was appointed by Governor Jan Brewer to the Homeland Security Senior Advisory Committee for the State of Arizona. He also has serves on the Arizona League of Cities & Towns Executive Board and as the Chairman of the Greater Arizona Mayor’s Association.

Vice-Mayor Patty Lasker was sworn in as a Prescott Valley Town Council member in June 2009. Prior to her election Lasker was a nurse, small business owner and investment advisor. She retired to Prescott Valley in 2005. She graduated from the Citizen’s Academy and is one of the founders of the Prescott Valley Old Town Board.

Wil Cardon: Congressman Jeff Flake Continues to Waste Money for Travel

Phoenix, Arizona – A recent study by CREW, Citizens for Responsibility and Ethics, found that Congressman Jeff Flake has no shame when it comes to the amount of government money he is willing to waste. Phoenix’s KPHO-TV highlighted the study’s findings in which Congressman Flake has reimbursed himself $20,000 for travel, meals and other expenses. In a time when our country faces over $15 trillion of debt and 14 million Americans are unemployed, Congressman Flake thinks we should be footing the bill for his extravagant congressional lifestyle. When KPHO-TV reached out to Congressman Flake for an answer on why he finds it appropriate to waste $20,000, the sixth term congressman had no response.

Study: Some AZ Reps. Use position to benefit themselves

PHOENIX (CBS5) – Do you ever wonder how much money your lawmakers give to groups?

A new study spells it all out for the United States House of Representatives.

Of Arizona’s seven representatives, only three are mentioned in the study.

The group behind it is CREW, or Citizens for Responsibility and Ethics in Washington.

It decided to look into how many U.S. representatives used their positions to benefit themselves or their families.

The group claimed the answer is more than half.

People like Rep. Ron Paul, who’s campaign paid more family members than any other representative, the study said.

You’ll also see Congressman Jeff Flake, Ben Quayle and Ed Pastor mentioned.

Quayle seems to be the lightest offender in the report.

It said he gave $250 to his dad’s company for facility rental and staffing services.

The report claimed Flake reimbursed himself nearly $20,000 for travel, meals and other expenses.

Then there’s Rep. Ed Pastor.

According to the report, his wife and nephew used to work with Chicanos Por La Causa, and CREW claimed Pastor has earmarked more than $1.8 million to the group from 2008 to 2010.

The report also said Pastor gave his daughter a big one up on the competition getting her a job at South Mountain Community College.

It said Pastor earmarked nearly a million dollars in 2008 and 2009 to the school’s ACE program and steered over a million dollars in federal grants to the program four months after his daughter was hired.

Coincidentally, her salary was at the very top of the pay scale.

CBS 5 News reached out to Quayle, Flake and Pastor for this story.

The only one who responded was Pastor.

His office said he has declined to comment.
