Democrats Have an Odd Way of “Boycotting” Committee Meetings

Democratic Leadership dismisses Committee, then obsesses with every move

(Phoenix, State Capitol) —-Democrats in the House and Senate have dismissed the Joint Legislative Committee on Redistricting as a “divisive partisan game”, but as Republican Committee members perform their Constitutional duty, the Democrats are the ones playing games.

The Joint Legislative Committee on Redistricting was formed under the Legislature’s comment authority in the Arizona Constitution. It is a bipartisan committee comprised of four Republicans and two Democrats. Just minutes before its first hearing on October 21, Democratic leadership announced it wouldn’t take part in the Committee. That “boycott” has taken a strange turn.

“Their chairs are empty, but they’re sure taking part,” says Senator Steve Pierce, a Republican from Prescott. “They are launching attacks on those testifying, they are going on Twitter to make accusations. They’re the partisan ones in this.”

In the six days of hearings, the Committee has listened to dozens of citizens who have been let down by the Independent Redistricting Commission. The Joint Committee will collect the information from these citizens and present a report to the IRC, as detailed in the Arizona Constitution.

Wes Gullett: Map hurts Phoenix

PHOENIX – Mayoral candidate Wes Gullett released the following statement today in regards to the proposed map up for consideration by the Arizona Independent Redistricting Commission:

“When Arizona voters created the Independent Redistricting Commission they charged that the Commission consider ‘communities of interest’ as one of the top priorities in drawing new Congressional and Legislative lines. If Phoenix, the largest city in the state and the sixth largest city in the country, is not a community of interest, I don’t know what is. The draft map released by the Commission takes Phoenix and slices and dices its residents into a cadre of proposed congressional districts. This map uses Phoenix residents as filler for other communities in an attempt to gerrymander the statewide map for political benefit. Phoenix residents deserve representation in Congress and a voice in elections as much as any other community in the state. The proposed approach robs them of that opportunity and would greatly weaken the involvement of Phoenix voters. I urge you to reject this proposal and adopt one that takes into account the City of Phoenix as an important ‘community of interest.’”

Arizona Independent Redistricting Commission op-ed by Senate Majority Leader Andy Biggs

When Arizonans voted to create the Independent Redistricting Commission in 2000, they likely expected they would get fair and transparent redistricting of legislative and congressional districts. Seeing how the current IRC led by Colleen Mathis is spinning out of control, even the IRC’s most rabid supporters must be disappointed.

The wobbly performance of the IRC began when Ms. Mathis sided with the Democrats and refused to let the Republicans on the IRC choose their own attorney! It continued when Ms. Mathis and the two Democrats on the IRC chose Strategic Telemetry to draw the maps of the new districts. Strategic Telemetry’s stated purpose is to elect “progressive” candidates. It’s understandable that people question that such a partisan firm will be able to put politics aside and draw fair districts.

That controversial decision was set up by the incompetent Commissioner José Herrera and Ms. Mathis. Herrera admitted publicly that he fudged the scores deliberately high for Strategic Telemetry. The fact that Strategic Telemetry was the most expensive bidder should have disqualified ST immediately. Instead, ST was allowed to lower its bid. The new bid was a smokescreen, however, because the IRC had to spend hundreds of thousands of dollars to pay for ST’s special software and office space, which competing bidders already had.

Failure to adhere to the normal public bidding process and being co-opted by the Democrats has accelerated the erratic behavior of Chairman Mathis. Arizona Attorney General Tom Horne is investigating allegations Mathis violated open meeting laws. Mathis and Herrera say they will not cooperate with the investigation. Instead, they have hired two attorneys with taxpayer money to defend them in this investigation.

Additionally, I have sent a statutory request for information to the IRC but have been ignored. Since the original request more than a month ago I have made two additional requests and still haven’t received the requested information. Between thumbing their noses at the Attorney General and stonewalling the requests for information from the Legislature, it has the feel of a blatant cover-up.

If Ms. Mathis is unwilling to act in an “independent and impartial fashion”, as required by the Arizona Constitution, she should be removed. The bidding process for Strategic Telemetry needs to be reviewed to see if state laws were broken. Mathis and Herrera need to come clean on whether they violated open meeting laws. Mathis needs to order her attorneys to respond immediately to my request for information.

Arizonans approved the IRC believing we would have a fair and transparent redistricting process. Ms. Mathis and her Democratic cronies have proven to be obstructionist, unfair, and obstinate in their duties. It seems that Ms. Mathis and Commissioner Herrera have failed in their constitutional duties to uphold “public confidence in the integrity of the redistricting process.” Therefore they should be removed in the manner that the voters insisted should be a safeguard to the process of redistricting.

Attorney General Tom Horne: Stonewalling Will Not Be Tolerated

HORNE RESPONDS TO REDISTRICTERING COMMISSIONER’S STATEMENT OF NONCOOPERATION; SAYS STONEWALLING WILL NOT BE TOLERATED 

PHOENIX (Thursday, August 4, 2011) — Attorney General Tom Horne today responded to a statement by Redistricting Commissioner Jose Herrera, who stated in public that he would not cooperate with the Attorney General’s investigation and that he would not answer questions from the Attorney General’s Office.

Horne stated: “It is not my job to become involved with political disputes regarding the commission’s decisions. It is my job to determine whether the law has been broken. Serious allegations have been made about possible violations of the law concerning open meetings law and procurement. If there have been no violations, we will indicate that, which will remove the cloud currently over the commission, and greatly benefit the commission in its work. If we find, on the other hand, that there are violations, it is my duty to pursue them. The public expects this of the Attorney General’s Office. The public also expects, in view of the importance of the commission’s work, that my investigation will proceed quickly, and that delaying tactics will not be tolerated.”

“I have no preconceptions as to whether or not the law has been broken, but stonewalling on the part of any commissioner will not work. It did not work in the Watergate scandal and it will not work here. My office will be relentless in pursuing the facts, and no commissioner will succeed in attempting to hide relevant facts.”

The Attorney General’s Office has been attempting to pursue this investigation in a cooperative manner, but will also pursue the investigation using other tools, as appropriate, including A.R.S. §38-431.06 which states, relevant to alleged violations of the open meeting law:

B. “… the Attorney General… may;

1. Issue written investigative demands to any person.

2. Administer an oath or affirmation to any person…

C. The written investigative demand shall:…

4. Specify a place for taking the testimony… “

Arizona Independent Redistricting Commission Update

Here is the latest news on the Arizona Independent Redistricting Commission.

Last night the Arizona Independent Redistricting Commission met in Glendale to discuss the latest machinations to redraw the multitude of new voter districts as mandated by the Constitution.

During that meeting, the commission went into an open legal briefing to discuss how the commission should handle a recently-launched investigation by Arizona Attorney General, Tom Horne.

Horne has taken an interest in the commission’s proceedings after public outrage occurred when and how the commission chose a Democrat-friendly mapping firm to redraw Arizona’s district lines. At question is how the commission arrived at its decision during executive session meetings and what information was used. For several weeks, citizen activists have sought information about the commission’s proceedings behind closed doors and how Strategic Telemetry was chosen without any public input. Public records requests have also revealed that some of the information has gone missing.

Yesterday, Arizona Capitol Times covered the meeting with primary coverage dedicated to the commission’s response to AG Horne’s investigation.

CapTimes  reporter, Christian Palmer writes the following:

Democratic Commissioner Jose Herrera said he had no intention of answering questions from the Attorney General’s Office, which he accused of waging a partisan investigation on the public dime that unfairly targets unpaid commission members.

“It shouldn’t be this way, where we have politicians trying to intimidate us,” said Herrera, who urged at the IRC meeting that fellow commission members resist Horne’s investigation.

During the meeting today, Kanefield informed the commission that Horne’s office is legally entitled and entrusted with investigating potential violations of open meeting laws, and as such has already been given written transcripts of the commission’s executive sessions.

Written transcripts, he said, could be used to pursue an investigation into possible violations of open meetings laws, while it remained uncertain whether the documents could serve a parallel purpose of pursuing an investigation of possible procurement violations.

That revelation prompted Herrera to declare that the Attorney General’s Office “should respect that we have legislative immunity” and that the prospect of involving partisan politicians in commission dealings was “sad.”

“I hope you protect us. That’s what you’re paid for,” Herrera said, speaking to IRC attorneys.

During the open legal briefing, the commissioner’s attorneys informed commission members that Arizona law extends commission members “legislative privilege” protecting them from being forced to disclose information used in any decision making process during executive sessions.

However, in an earlier Arizona legal case, Arizona Independent Redistricting Commission v. Fields, the court ruled that the commission could protect information related to the actual process of crafting the district boundaries. The commission’s attorneys did not answer the question of whether the commission’s recent administrative actions – of actually choosing the firm Strategic Telemetry – would be protected under legislative privilege rather than under normal administrative actions and thus, under Arizona’s Open Meeting law.

At the hearing, both Democratic commission members, Jose Herrera and Linda McNulty appeared defensive and concerned about the AG’s investigation while both Republicans on the commission, Scott Freeman and Richard Stertz were willing to cooperate with the AG’s office.

The next meeting of the Arizona Independent Redistricting Commission will take place on Friday, August 5th at 6 PM at the Burton Barr Central Library in the Pulliam Auditorium.

Independent Redistricting Commission Snubs Mohave County

(STATE CAPITOL, PHOENIX) – The Arizona Independent Redistricting Commission hasn’t even had its first public hearing, and already the Commission is creating controversy over the way the hearings are handled. Sen. Ron Gould of Lake Havasu City discovered today the Commission may send only one of its five members to the sole IRC hearing in Mohave County. Previous meetings in Phoenix and Tucson have been attended by all five members.

“I guess the rules are different outside of Maricopa and Pima counties. In the IRC’s mind, the full Commission doesn’t need to hear the concerns of Mohave County residents. One member is just fine. That’s an insult,” says Sen. Gould.

The public hearing is scheduled for Tuesday, July 26 at 6 p.m. at Bullhead City Council Chambers.

“You’ll have people coming from all over the county to Bullhead City for this meeting. These people care about the process. It’s a real slap in their faces,” says Sen. Gould.

The IRC is also now the target of a probe by Arizona Attorney General Tom Horne, over accusations of violations of open meeting laws and procurement laws.

Arizona GOP Chairman Morrissey Applauds AG Horne Investigation into IRC Process

Arizona Attorney General Tom Horne Authorizes Probe into Independent Redistricting Commission

PHOENIX (Thursday, July 21, 2011) — Attorney General Tom Horne has authorized his office to conduct an initial investigation of the Arizona Independent Redistricting Commission based on reports that raise questions about the Commission’s compliance with Arizona’s Open Meeting Law and procurement laws when it recently entered into a contract with Strategic Telemetry to provide mapping consultant services.

“I need to emphasize very clearly that this is an initial investigation that will attempt to determine if any violations actually occurred,” Horne said. “I am concerned about reports that have raised questions about some of the procedural actions taken by the commission, and I am committed to finding out whether those concerns warrant any further investigation. If this initial investigation finds that laws have been violated, we will proceed accordingly.”

Arizona ‘Independent’ Redistricting Commission Picks Leftist Progressive Firm to Map Arizona Lines

The Arizona ‘Independent’ Redistricting Commission voted today to hand off the task of mapping the new electoral district map to leftist progressive Washington, D.C. based firm called Strategic Telemetry.

The vote was 3-2 with Colleen Mathis, the so-called ‘Independent’ Chairman, voting with the leftist Democrats. (View Colleen Mathis initial application.)

Given Arizona’s latest voter registration data, one would think that the Chairman would have sided with the Republicans on the commission. Republicans currently lead in voter registration with Independents following in second place. Democrats have been left to wallow in third place, third party status.

Nevertheless, the vote went with the leftists on the commission leading some to believe lawyers are already lining up to challenge whatever is crafted by the leftist firm which only works with progressives.

As microtargeting has become an indispensable tool for political campaigns, operatives are learning to harness the power of predictive analytic techniques to analyze and model voters’ attitudes and behavior. Campaigns increasingly deploy these data to identify receptive voters and to devise effective communications and mobilization techniques.

Ken Strasma, president of Strategic Telemetry and the national target director for Obama’s 2008 presidential campaign, is a pioneer in the application of high-tech statistical modeling for political campaigns. His Washington, D.C.–based firm, launched in 2003, has led numerous campaigns to victory, including many Democratic campaigns as well as New York City Mayor Michael Bloomberg’s 2009 re-election campaign.

In February, 2010, Strasma wrote a guest opinion for Campaigns & Elections entitled, “Targeting the Most Unusual Electorate in America.” In that piece he wrote:

“Bloomberg’s decision to switch his party affi liation to independent, and his progressive positions on most issues was what led many Democratic consultants, including my firm, Strategic Telemetry, to support him.”

In another expose about Ken  Strasma that appeared in Fast Company, his bio description reads:

“Ken Strasma, 42, focused on microtargeting as research director of the National Committee for an Effective Congress, a progressive lobbying group. He now heads targeting efforts for Barack Obama’s campaign.”

Strategic Telemetry’s Facebook page gives the company overview as follows:

“Strategic Telemetry provides data analysis, strategic advice and statistical modeling of individual-level voting behavior to progressive organizations and campaigns.”

In a March 1st post on The Daily Kos titled, “Some Wisconsin Democratic senators looking to return, recalls loom” Strategic Telemetry is cited as asserting:

“Further, a micro-targeting firm called Strategic Telemetry, run by President Obama’s 2008 campaign micro-targeter, suggests that there are twice as many Wisconsin residents willing to sign a recall petition against Walker as would be necessary to make such a petition valid.”

The Atlantic also wrote an article about Strasma and his company in February in which it discussed a potential recall effort of Wisconsin Governor, Scott Walker:

“34 percent of Wisconsin voters would sign a petition to recall Walker, according to a survey of 806 voters by Strategic Telemetry, the Democratic polling and microtargeting firm run by Wisconsin native Ken Strasma.”

“One big caveat: Strasma is a Democratic strategist who has done microtargeting for the presidential campaigns of Barack Obama and John Kerry. While he told me he conducted this poll on his on initiative (not at the behest of a Democratic client), it’s worth keeping in mind that the poll appears designed for news value.”

and,

“Strasma e-mails to say the GOP senators in his poll are eligible for recall: ‘… the eight GOP senators listed are the ones subject immediate recall. WI has staggered four year State Senate terms, so half of the Senators are up each year. The eight who were first elected or reelected in 2008 are subject to recall at any time. The ones elected in 11/10 would not be subject to recall until 1/12.’”

There is plenty more information available on Strategic Telemetry’s website to document the firm’s involvement in controlling progressive politics in the United States.

I have to imagine that the reason why the Arizona Independent Redistricting Commission spent hours in Executive Session today was to battle over the hard reality that a 3rd party ranked Democratic party was about to decide on selecting one of the most leftist leaning redistricting firms in the country and the Republicans on the commission were doing everything in their power to keep that from happening. This information on Strategic Telemetry had to have been available to them and they must have made every effort to smack some sense into Colleen Mathis before she sided with the minorities on the commission.

I would expect the attorneys are already preparing for the legal battle that is certain to ensue and certainly with good cause.

If you haven’t already called your elected officials to complain about this trajectory toward electoral injustice, I urge you to do so quickly.

UPDATE: (July 6, 2011)

On April 20, 2011, the Arizona Independent Redistricting Commission interviewed and selected Raymond F. Bladine to the position of Executive Director of the commission. Bladine had previously applied for the position of Chairman of the commission. Here are the minutes to that meeting. What is interesting about the process is that Colleen Mathis, the Chairman, actually made the motion for unanimous approval of Bladine to the position. (This is unusual since Robert’s Rules of Order calls for a member other than the chairman to make nominations.) Here is Bladine’s original IRC application.
