Cease and Desist request from RNC

Espresso Pundit mentioned that a Cease and Desist order had been sent to the Firefighters union behind the ads for Kevin Gibbons and Pete Hershberger. We have obtained a copy of the letter and you can read it here (PDF format.)

A salute to Arizona State Republican Party Chairman Randy Pullen for alerting the RNC to this misuse of a Republican symbol.

    It’s not clear to me how people who are REPUBLICANS are violating any copyrights by displaying a Republican logo.

    Maybe it’s just me, or maybe you guys really do see your party as an exclusive invitation-only club. Actually that would explain a lot.

    The fact is, these unions are not Republicans and they are supporting some Republicans, but not others. All the while, extolling the virtues of a party that they don’t belong to.

    The signs were not put up by Republicans. They were put up by a PAC doing an independent expenditure. They apparently were not authorized to use the copyrighted logo of the Republican Party.

    Take a look at the PAC (Protect Arizona’s Future) and who they’ve tried to help or hurt and it’s easy to see they’re not trying to help the Republican Party.

  12. That’s progress by Chairman Pullen. What about the damages that have already occurred and are continuing? The independent expenditure committees had no right to use the GOP logo. Their attack video against Rep. Pearce has been viewed thousands of times. Where are damages for the GOP and for Rep. Pearce?

  13. I don’t really have a dog in the fight, but I can tell you that about three quarters of the Protect Arizona’s Future signs put up in Tucson are placed illegally and will need to be removed.

    Just a guestimate, but I would suspect that the cost of the signs, installing the signs, and now, removing the signs will be much more than five or six thousand dollars which will be matched to Al Melvin.

    Had a “private expenditure group” just handed several thousand dollars to my opponent with no lasting value to me, I’m not sure that I would be pleased.

    Protect Arizona’s Future is working on behalf of duly nominated Republican candidates.

    Why can’t they state that the Republicans they support are better candidates than OTHER Republicans running for the same race?

    I remain puzzled. I am a registered Independent/No Declared Party who has voted in Republican primaries.

    Should I cease and desist from supporting Republicans because I am a registered independent?

    If the answer is yes, it’s a heck of a way to win elections.

    They are also supporting John Zerby in LD-4 against Jack Harper. Someone named “Robbie” from “Your Local Firefighters” left me a nice message on my answering machine. I REALLY wish I had been home. Robbie, if you’re out there…gimme another call. I dare you.

    Maybe the firefighters and even police have gotten a little sick of some conservatives who wish to cut the taxes and spending that go to pay their salaries to keep us safe. I suspect they are supporting GOPers (you call em Rhinos) who support PUBLIC safety…yes…PUBLIC.

    I support our police and firefighters. They deserve a raise. All they get out of many in your party is two-faced statements like “support our firefighters and law enforcement” and then you cut the lifeblood of tax dollars that we use to support them.

    Go ahead, keep attacking them.

    I don’t think it is a matter of calling the cops. I have been busted for a sign twelve inches out of a “designated free speech area” in Oro Valley, they are certainly not going to overlook a 4X4 sign three blocks away.

    I counted at least 4 on Oracle which is state highway and is off limits, and a few more in Tucson proper which are only placeable on private property by city code.

    If they wish to challenge the different city codes and fund the lawyer to do so, that would certainly be worthwhile (I’d love for that to happen for selfish reasons) otherwise a good portion of the signs will likely be taken down within the week.

  21. Fair use doctrine permits the use of copyrighted materials for satire, critical address, and academic use… at least, last time I looked, that was how law itself worked: we obey what’s actually written down.

    However, the other key here is that any satire must clearly be satire. In order to not violate the law, they have to label anything that isn’t clearly a joke as a joke. They didn’t.

    But that’s copyright.

    There is no “fair use” clause in trademark law. A trademark is a trademark and may not be used by anyone but the trademark owner without permission. That’s how the GOP might succeed in quashing these.
