Scott Bundgaard Guest Opinion

I have never hit, pushed or abused any woman. Ever. I have never invoked legislative immunity to escape justice. On the night of February 25, 2011, I was the “victim” according to Phoenix Police officers and their reports, given a “victim rights pamphlet” and later assigned a “victim rights advocate” by the City of Phoenix Prosecutor’s Office Victim Services Unit.

Since there was no charge made that night against me, why would I assert immunity? So what changed over the following three weeks? The extensive Notice of Claim that was recently filed demonstrates that the City of Phoenix engaged in collusion and cover up in order to intentionally and maliciously destroy me.

One might ask why I waited until now to respond. I accepted a “no contest” plea agreement from the City of Phoenix Prosecutor’s Office in August, 2011, because I could not afford the “expensive court battle” that was promised by the Phoenix prosecutor.

For six months, I operated under an agreement that could have been revoked at any time and for any reason. I could not respond to the lies being perpetrated by certain Phoenix Police officers at the Senate Ethics Committee hearing without jeopardizing this agreement. I resigned from the Senate, because it was useless to respond.

It has only been over the last five months that I have realized the extent of collusion, cover up and corruption by the City of Phoenix in order to wipe me out. Those facts are presented in the Notice of Claim and is available to the public. The shocking and unacceptable practices by the City of Phoenix must end. As to State Senator Ron Gould and his Kangaroo Court, he expressed bias against me publicly for months prior to his hearing last January. He intentionally suppressed exculpatory evidence and colluded with the lead PPD investigator in this matter to further perpetrate this fraud. When people such as former Mayor Phil Gordon and State Senator Ron Gould can use their elected office for intentionally malicious purposes, it is unethical and must be exposed.

I would not wish upon anyone what I endured the past year: false accusations, intentional public defamation, political vengeance, collusion and corruption by city officials, sham proceedings, and personal and professional degradation that resulted in losing all of my income. If you want to know ‘why’ I would sue the City of Phoenix for $10 million, ask yourself how much you would have to be paid to endure personal, professional and financial destruction.

Politicians from all political parties must confront the serious issues facing our country instead of playing political games with our tax dollars. The citizens who elected me were deprived of their choice of senator by a political abuse of process. We all pay a price when the police are used as a weapon against political rivals. Taxpayers must demand public sector reforms in order to prevent further legal actions such as mine.

Sincerely,

Scott Bundgaard
