Getting taxpayers off a dangerous hook

The City of Glendale, Ariz. is planning to borrow $100 million so it can send a check for that amount to Chicago businessman Matthew Hulsizer to help him buy the Phoenix Coyotes. That type of transaction is exactly what the Gift Clause of the Arizona Constitution was designed to prevent: furnishing public debt or providing public funds to a private individual or corporation for personal gain.

The deal has the team selling parking rights to the City, which the dealmakers say will provide sufficient revenues to repay the bonds. But there are two problems with that. First, the City may already own some or all of the parking rights. Second, it’s quite clear the revenues will not come close to repaying the bonds.

So the City pledged sales and excise taxes as collateral for the loan. That means if the team goes bankrupt again, or if parking revenues fall short, taxpayers are on the hook for potentially hundreds of millions of dollars–on top of the $180 million the City borrowed to build the hockey arena in the first place.

The solution is simple: take the taxpayers off the hook, and place responsibility where it belongs: with the new owner.

The City and Hulsizer share two dubious beliefs. First, although the Coyotes have lost $25-$40 million every year and already have plunged into bankruptcy, they think Hulsizer can make the team profitable with “a few tweaks”. Second, they say parking revenues will suffice to repay the bonds.

If they truly believe those things, then there should be no problem with Hulsizer, rather than the taxpayers, borrowing the money. That way, if the shaky premises on which the deal depends prove faulty, Glendale taxpayers will not have to pay for another costly blunder by the City of Glendale.

If the City truly wants to keep the Coyotes, it should act within the law and stop playing Russian roulette with taxpayer money. If Hulsizer is willing to skate up to the puck, the Coyotes’ endearing mascot Howler need not be an endangered species.

Arizona State Senate Vote Detail on SB 1322

Here is today’s vote detail on State Senate Bill 1322:

Here is the bill summary:

Purpose: Requires a city with a population of over 200,000 persons to furnish all municipal services with an anticipated cost of greater than $50,000 via a service contract that has been entered into through open and competitive bidding.

Background: The governing body of a city or town, may, by ordinance, create the office of city or town manager, and appoint a person to fill that office.

Cities are responsible for providing services for the benefit of the public or its residents, including all related internal management services, support services, enterprise and fee-funded services and administrative services including municipal judges, police services, municipal firefighters, 911 operators, tax collection and audit enforcement services.

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

My guess is that several Republican Senators just invited a Primary challenge in 2012. Republicans Rich Crandall, John McComish and John Nelson voted with the Democrats AGAINST the bill.

 

 

 

Criminal Allegations Against Chairman Pete Rios Sent to the Arizona AG to Investigate

On January 27th, 2011 the Pinal County Sheriff’s Office received the attached letter from a “Concerned Citizen.” The Pinal County Attorney’s Office received the same letter. According to the letter, it was also sent to numerous media entities. The individual has raised issues regarding the residency and reimbursement requests for travel by Pinal County Board of Supervisor Chairman Pete Rios. If the allegations are true, they would be Theft and Fraudulent Schemes both of which are felony offenses.

The Pinal County Sheriff’s Office and County Attorney’s Office agreed the investigation would best be handled by the Arizona Attorney General’s Office. On February 9th, 2011 Chief Deputy Steve Henry forwarded the investigation to the Arizona Attorney General’s Office.

The Pinal County Sheriff’s Office has received media inquiries regarding this case as well as calls from citizens with information pertaining to this case. I am asking that all media inquiries and individuals wanting to forward information related to this investigation to please contact the Arizona Attorney General’s Office.

Sheriff Paul Babeu stated, “These are serious allegations against a well known political leader and Chairman of our Board of Supervisors. The allegations are best investigated by a neutral outside authority. Transparency will prove to be the best manner in which to overcome the past reputation of corruption in Pinal County.”

Attached is a citizen complaint letter which was submitted to Sheriff Babeu and Pinal County Attorney James Walsh by a citizen requesting an investigation into Pinal County Board of Supervisor Chairman Pete Rios. The Letter alleges Mr. Rios does not reside within the boundaries of his supervisory district. It also alleges Mr. Rios has submitted fraudulent travel vouchers and received payments from the county and also the state.

As you may be aware, Mr. Rios is currently the Chairman of the Pinal County Board of Supervisors and has also served in both the house and state Senate, where he served as Senate President. If the allegations are true, this will certainly prove to be a high-profile public corruption case, due to the significance of the criminal allegations and the political standing of Mr. Rios.

Attached are photos which have been forwarded to my office of these properties in question and some of his past reimbursements. Also attached are letters that have been submitted in the past to the media regarding this same issue by concerned citizens.

To avoid any possible conflict, I am requesting your assistance in investigating this matter to determine if it is credible. If the investigation supports the claims by this citizen, I ask that appropriate charges be filed

Sirs,

During the past two decades, Peter Rios has committed theft and fraud from Arizona taxpayers and it is time he be held accountable. Peter Rios lives at [redacted] East Mesquite, Apache Junction. I know this because neighbors who live next to him have confirmed he has lived there full time for many years. On the Pinal County website Mr. Rios says he lives in Dudleyville and has a temporary residence in Superior. Although Apache Junction is in Pinal County it is not in District One which he was elected to represent.

Mr. Rios commits theft and fraud each and every month when he submits paperwork to Pinal County for reimbursement. He lists his travel from the residence in Dudleyville ( [redacted] Malpais Road) or Superior ([redacted] West Palo Verde Drive). Both Dudleyville and Superior are within District One which he represents.

  • The miles according to Mapquest from his home in Dudleyville to Florence is 83 miles.
  • The miles according to Mapquest from his home in Superior to Florence is 30 miles.
  • The miles according to Mapquest from his home in Apache Junction to Florence is 32 miles.

Although living in Apache Junction Mr. Rios has claimed mileage reimbursement from Dudleyville during his time in the State Legislature and now for the past several years with Pinal County. Not only does Mr. Rios not live in the district he was elected to represent but he has stolen tax payer money with his fraudulent mileage reimbursement. This fraudulent practice has cost the state of Arizona taxpayers thousands and thousands of dollars.

If there is any doubts as to his residency, just ask the neighbors who live in his Apache Junction neighborhood and they will confirm he lives there full time.

As a Pinal County taxpayer, I demand an investigation into this manner. Pinal County is hurting for money just as every other county across our state. Why should an elected member sworn to represent us be allowed to steal from us.

But won’t spend ten dollars to register Sheriff Arpaio’s bus!  

Nickname is catching on: “Worst-run County in America”

 

It is astounding that the Maricopa County Supervisors continue to spend millions of dollars right under our noses, arrogantly increasing deficits at a time when governments all across the country are going bankrupt. We spotted ads for one of the county agencies under their authority on the ABC-15 website. There were two ads on one page! There is a video ad running before ABC-15′s videos, as well as a banner ad on the other side of the webpage (you may have to hit refresh a couple of times to see the video ad, since it rotates with a couple other ads for Hastings & Hastings and a jewelry store). This is a complete abuse of our taxpayer dollars at a time when the Supervisors are trying to lobby the state legislature for even MORE money. What, more money to spend on advertising the county agencies they head?

Inside sources tell us the Supervisors are buying all the ads on ABC-15 as payback for ABC-15 getting rid of ace investigative reporter Josh Bernstein, who was one of the only reporters in town who dared look into the Supervisors’ corruption. We have been told that the Supervisors complained to ABC-15 management about his coverage, and management told him to lay off the coverage or he would be out. He didn’t back off and sure enough, his contract was not renewed. Bernstein, who is very liberal, had no agenda, he simply sought out corruption wherever it occurred, on the left or right. Too bad the Supervisors were able to hurt the career of yet another honest person who dared to expose their dishonesty. The Phoenix New Times has more on what happened here

Another incredibly irresponsible expenditure by the Supervisors is $15 million for a payroll service that still isn’t up and running after four years of paying the company to set it up!  ADP is one of the top payroll providers in the business, and has successfully set up payrolls for other government agencies all around the U.S., so you know it is not due to their incompetence. Someone like the Goldwater Institute needs to do an investigation and find out where the incompetence is. We know the Arizona Republic won’t bother because they’re in bed with the Supervisors (remember the Supervisors have ensured favorable coverage from the Republic by hiring away the Republic’s editorial writer Richard DeUriarte a couple of years ago as their Public Information Officer. They also ensured positive treatment from the courts by hiring away the court’s prior spokeswoman Cari Gerchick as a second PIO)

The Supervisors refuse to approve the registration of Sheriff Arpaio’s bus – even though they lost their lawsuit against him for buying the bus! Meanwhile, they operate top of the line Prevost buses to shuttle their employees back and forth from parking lots to the county building. The buses are frequently empty, and when they aren’t empty there are usually only 1-2 employees in them. There is no reason for these extravagant buses. They could easily shuttle the employees back and forth with small shuttles like Dial-a-Ride. But the Supervisors don’t care about being financially responsible with our tax dollars. They spend all their time trying to punish other county agencies and get their electeds in trouble, time that would be better spent reviewing their own bloated excesses.

Please send this to everyone you know and contact the Supervisors and tell them to STOP WASTING OUR MONEY! There is a slate of candidates being formed to run against the Supervisors in 2012, if we can’t stop them now, we will shut them down in 2012. This is still very much a “he said, she said” story about what happened late one Friday night on Highway 51.

If Senator Bundgaard is telling the truth, Ballard will likely be prosecuted heavily for any number of crimes. But if Senator Bundgaard is lying, this will be the end of his political and professional career.

I told people I would clear my name. This is one step in that process. There will be others in the next several days. We are working closely with law enforcement and are optimistic of a resolution soon,” Bundgaard said.

BREAKING! Bundgaard notifies GOP Caucus, Ballard pulled gun

The Arizona Guardian is reporting that State Senator Scott Bundgaard notified fellow Senate Republicans that a gun was involved in the recent highway altercation.

During a closed door session in which the GOP caucus was to consider the fate of the Majority Leader, Bundgaard revealed new information that his ex-girlfriend had pulled a gun on him while he drove home after the Dancing with the Stars event. Apparently, Ballard was intoxicated and angry and pulled the gun belonging to Bundgaard from inside the vehicle as they argued.

Nowhere in the police report does it mention that Ballard was intoxicated nor does it mention anything about a gun.

Sonoran Alliance has learned that Bundgaard apparently notified police about the gun during the incident. Phoenix police took down details about the make and model of the gun before returning it to him. Still there is no mention of the gun in their report.

Police also failed to mention that Bundgaard called a family member to assist at the incident and that a breathalizer test was performed.

This story continues to intensify especially as public criticism mounts against Bundgaard and new revelations about a failure to report critical details by Bundgaard, Ballard and the Phoenix Police Department enter the public arena.

Will Bundgaard’s shocking revelation be a game changer to the story or will the public see it as a desperate act? And will the Phoenix Police Department deny the latest claim or admit to another investigatory bungling? The courts will likely have the last word.

Re:  Municipal managed competition reform (SB 1322)

Dear President Pearce and Speaker Adams:

We are writing to you and to the members of your chambers to ask for your support in passing Senate Bill 1322, the municipal managed competition reform. 

SB 1322 would require Arizona cities with populations of 500,000 or more to open up city services to competition from the private sector.  The bill has three main policy objectives:

• Create jobs.  By requiring an open and competitive bidding process, SB 1322 will allow private businesses, public-private partnerships, and city employees to compete to provide services to city residents at the lowest prices compatible with the highest quality and most reliable performance.  Competitive bidding will help to moderate the costs of all productive factors, including labor, thus allowing thousands of new workers to be hired.  (For example, in Fiscal Year 2010, the City of Phoenix paid its average worker a salary, benefit, and overhead package of $97,707.  That was up from $83,231 in FY 2007—a 17-percent increase in just three short years, at a time when private-sector workers were suffering pay cuts and layoffs.  Even if we take out police officers and firefighters—who would be exempt from SB 1322—competitive labor costs could allow the Phoenix economy to employ one and a half times the current number of city workers, at the average private-sector salary-and-benefit level.) 

• Save money for city governments and city taxpayers.  By saving money on maintenance and operations costs, SB 1322 would free up scarce budget resources at a time when cities are facing tough budget constraints.  The combined savings in Phoenix and Tucson could soon be over $500 million a year—savings that could be passed on to taxpayers through rollback and repeal of recent tax and fee hikes.     

• Create opportunities for small business.  SB 1322 will help to inject hundreds of millions of dollars a year into the local economies in Phoenix and Tucson.  By requiring those cities to bid out services costing above $75,000, SB 1322 would create opportunities for dozens of small businesses to win contracts to perform city services. 

SB 1322 gives city councils opportunities to disapprove statements of work presented to those councils by city managers, and allows city councils to award longer-term contracts to independent contractors and public-private contractors that provide significant capital investments to the cities. 

SB 1322 includes several key protections for taxpayers and several provisions designed to ensure that contractors serve as faithful stewards of public resources:

• Transparency in bidding and performance.  SB 1322 stipulates that all bid-related communications and supporting materials submitted for consideration by the affected cities shall be public records, and mandates that the city managers and all city departments of affected cities shall conduct annual performance audits for contracted services, the cost of which must be accounted for and incorporated into all bids.  SB 1322 requires city managers of affected cities to seek independent performance audits every five years to evaluate the accuracy and completeness of the municipalities’ performance audits, and stipulates that all performance audits shall be public records.

• Protection of city resources.  SB 1322 requires that all bidders, public or private, must be able to provide bonding or other forms of security to adequately protect cities, and requires that all bidders maintain an adequate level of liability insurance consistent with the city risk management requirements.

• Public safety provisions.  SB 1322 requires that independent contractors have appropriate safety policies and procedures in place to protect the public and its employees, and requires that independent contractors perform background checks on employees performing any service for which the affected cities require background checks of municipal employees.

• Breach-of-contract protections.  SB 1322 mandates that independent contractors acknowledge that the affected cities may rightfully terminate and rescind contracts awarded to independent contractors in the event of material breaches of those contracts.

• Term limits for service contracts.  SB 1322 provides that service contracts may not have terms longer than five years, with three one-year renewals, before the related services must be submitted again to open and competitive bidding.

• Term limits for capitalization projects.  To address policy concerns voiced in committee, the proposed floor amendment to SB 1322 allows for longer terms to be awarded for contracts with independent contractors or public-private partnerships that involve significant capital investments.  But the proposed amendment also limits the terms of those contracts to the length of the amortization schedules prevailing in those industries.

Given the wide latitude allowed to city councils and city managers in designing service contracts, SB 1322 includes a taxpayer standing clause that allows taxpayers residing in the affected cities to bring special actions in court to enforce the protections afforded in the legislation.

Once the success of this managed competition reform has been demonstrated in Phoenix and Tucson, it is our firm hope that future Legislatures will expand the reform to include all of the municipalities and counties in Arizona, thus providing its protections to all Arizona taxpayers. 

Upon request, we will provide you with a copy of the draft floor amendment which incorporates changes suggested during the Senate committee hearings and changes suggested by stakeholders.

Trent Franks seriously considering US Senate bid

The East Valley Tribune is reporting that Congressman Trent Franks is evaluating whether or not he should enter the race for US Senate in Arizona. Unlike Congressman Jeff Flake who announced literally days after Jon Kyl’s retirement announcement, Congressman Trent Frank is taking more time to weigh the decision as he prays and seeks counsel with his constituents.

At a West Valley Republican meeting this last Saturday, Congressman Franks spoke about the decision which was also prodded by a spontaneous poll of its members. He received overwhelming support for a potential bid.

Franks also discussed three major areas which he believes are critical to our national survival: the economy, national security and Constitutional adherence. The congressman currently serves on several subcommittees for the House Armed Services Committee and the House Judiciary Committee where he plays a strong role is support of national defense and the fight against international terrorism. He is also one the strongest advocates for protecting marriage and the human rights of the unborn.

Congressman Franks is expected to make a decision by April 7th.
