Today, Dee Dee Blase of Somos Republicans filed paperwork forming a political committee to recall State Senator Russell Pearce. The committee, using the name Arizonans For Better Government, is based out of a P.O. Box based in Scottsdale (document). Senate President Russell Pearce serves in Legislative District 18 which only covers west Mesa. A total of 7,756 valid signatures must be collected by May 27th in order to force the recall for the ballot.
Today’s committee announcement was probably in the works as Somos Republicans anticipated legislation forcing clarification and enforcement of the 14th Amendment. That legislation was introduced today and likely triggered the recall. As much as Senator Pearce has been on the forefront of efforts to tighten illegal immigration law, he is not the prime sponsor on the legislation. Instead, Senator Ron Gould and Representative John Kavanagh are the prime sponsors along with multiple co-sponsors. No recall efforts have been launched against either Gould or Kavanagh.
At the heart of the legislation is the Fourteenth Amendment, Section 1 which states the following:
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
The operative clause in that section is “and subject to the jurisdiction thereof.” Many anti-illegal immigration advocates believe that birthright citizenship should not be determined based on one’s GPS location at the moment of birth.
Blase is no stranger to confrontational politics. On the Somos Republican website, visitors will find constant verbal attacks on conservative Republicans such as congressional candidate Janet Contreras, Maricopa County Attorney Bill Montgomery and Governors Jan Brewer and Sarah Palin.
Recall campaigns are extremely difficult to win first, in obtaining the number of valid signatures and second, through winning in the election process.
Having worked in west Mesa legislative campaigns, I believe this effort will fail and may actually be more of a public relations stunt to bring exposure to Somos Republicans cause.
Good luck Dee Dee but I will be supporting the efforts of Senator Pearce and the Arizona Latino Republican Association.

As a conservative who strongly believes in the rule of law, I feel that — regardless of the merits of the birthright argument — the 14th amendment cannot be thus changed by statute (not even a federal statute).
One can argue the case from an original intent perspective and perhaps win the argument. But even the incidental, positive impact on Chinese immigrants was recognized by the politicos of the time. However, from a strict constructionist point of view, the current application of the amendment to birthright citizenship seems clear.
I guess we’ll find out how many strict constructionists we have in the legislature. And, yes, the recall will go nowhere.

For once I think I agree with you. It’s a slippery slope to ignore the original intent and explicit language of the constitution whether in the cause of the left or the right. Of course, it _is_ a living document in the sense that there is a procedure to amend it — something we’ve done about every 13 years excluding the Bill of Rights.

When Congress passes law, there is something called, “the Blue Book”, I believe. The goal of which is to explain the background, philosophy and/or intent of the legislation.
The same is true about the Constitution, as in the Federalist AND Anti-Federalist Papers. The object of these documents were to explain and either defend or attack the proposed Constitution.
Regarding the 14th Amendment, there was VERY clear language at the time; AND the clause, “…subject to the juridisction thereof…” was VERY CLEARLY explained.
The Supreme Court has not ever taken up this issue and the Proposed law sponsored by Mohave County’s Ron Gould (WHO appeared on Fox News Wednesday about this very issue) should force SCOTUS to look up the law.
Lastly Ken, there is NEVER a reason to agree with ‘Clueless in Phoenix’ Klute. His attitude towards the Constitution reminds me of the difference between an accountant, an attorney and an actuary. Ask each of them, “What does 2+2=?

This is not an attempt to redefine the Constitution, it is an attempt to return the interpretation of the Constitution to its original purpose in opposition of the biases interpretation pushed by the Progressive Democrats who have been in charge of the Washington bureaucracies since the twenties. The 14th amendment is not ambiguous, but we have to go back to the historical context: this was done to give citizenship to the children of slaves. Nowadays, this problem is moot. We all know that anchor babies are a reality. In my opinion, this creates a danger to our security. What is stopping terrorists from having anchor babies of their own? These children raised to hate us would make great homegrown suicide bombers for instance.
As for recalling Senator Pearce, good luck with this idiotic idea. Pearce is, with Kavannagh, Gould and a few others, a man, not a politically correct sissy. Klute embraces the 14th, Section 1 but like many Liberals ignores what he chooses. Note Section 5: “5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.”
The intent is to restore the intended interpretation of this amendment; it’s been abused by the pro-illegal alien groups.
States (I believe 20 at last count) enacting such legislation hope to force the SCOTUS to make a decision on the issue of the spawn of illegal alien criminal lawbreakers. The matter has never been decided there, and it’s long past time the 9 black robes did their jobs.
Should the SCOTUS decide in favor of illegal alien invaders’ spawn, the need for a constitutional amendment will be clear. At this point, Congressional definition of the meaning of “…subject to the jurisdiction thereof” may be sufficient. All depending on the 9 black-robes.

The McCain camp certainly would have the money to fund keeping birthright citizenship, and Anthony recently announced his two new endeavors: Arizona First PAC and the Arizona First Foundation.

There IS actually a very good reason to review the 14th Amendment, in the manner that the Founders agreed might be necessary to review.
In 1780, it was very hard to get to America. Long sea voyages at great expense, often paid for by years of indentured pay-back. People who left their homes and all they knew to take the risk to go to America pretty much couldn’t ever go back. Overwhelmingly it was a one-way trip, irrevokable.
Mexico was far from the colonies, under SPanish colonial rule. The desert was a natural barrier that discouraged passage into even more desert.
The Founding Fathers were not able to predict that people from France could be in Philadelphia in 8 hours. Japanese can arrive in Phoenix in 16 hours. Mexicans can drive from Mexico City to Phoenix, San Diego, ALberquerque, Houston, a score of other major cities in less than one day, ANYWHERE in the USA in five days by road, in hours anywhere by plane.
A pregnant women from Buenos Aires can literally board a plane and just hours later, deliver her baby in the USA. Instant citizen by geographical location ONLY. No ties, no commitment, no investment in the nation. Our incoming flights have women who have bought a ticket EXPRESSLY for that purpose. They, just like a woman who drives into the USA, or walks in thru the desert are not citizens, they aren’t even residents, they are OPPORTUNISTS.
This is a genuine case where unforseen circumstances have affected the purpose of the Amendment – which has been discovered by millions of foreigners as a slick way to obtain citizenship and a US passport.
Britain was stopping US ships, grabbing naturalized American sailors who had fled to the USA and obtained citizenship, claiming they were STILL British, and hanging them.
There were urgent and life-preserving reasons to assert the validity and guarantee of American citizenship.
The Founding Fathers did not predict an abusive and manipulative industry in citizenship with no intention of actually assimulating once the physical barriers to traveling to the USA were eliminated.
So, a careful review given the change in circumstances and the level of abuse of the right of citizenship is in order. It may not be necessary to change the Amendment, but change our VISA and immigration approvals and procedures. A GOOD review will examine ALL factors.
You can spend all the time you want exploring the intent and meaning of every word of the Constitution. It is a worthwhile pursuit, for some. Today I looked on the New Times’ website and, sure enough, a second recall effort has been started. A group calling itself Citizens for a Better Arizona now has a FaceBook group page on which it has posted its leaders, its intent – and some potentially damning information on the level with another ACORN-like move.
DeeDee is in all the major high Hispanic populated states, she lists her State Directors. She is in Texas, California, Nevada, Florida, Illinois, Colorado, and a whole bunch more. According to her website, her organization influenced the bypass of Steve King who was expected to be promoted. You can’t do what she has done as a “one woman organization”. I suppose you think the photos on their website are fake, too?

2. 50% reduction in immigrant related crime since Pearce took office;
3. 95% of all commercial space is leased;
4. 97% of all small businesses are profitable and offer;
5. The most educated district in Arizona;
6. Attracting 2,500 Microsoft jobs to west Mesa;
7. Home values have gone up 25% over the last 3 years;
8. Not only are the Cubs staying but the Yankees will be spring training here too.
The numbers don’t lie Somos! Check your facts. District 18 is laughing all the way to the bank.

Our only issue is this: if you want to stop the handouts, welfare system, and free social services from draining the state, end those first!
As a metaphor, a restaurant that’s lacking in good food won’t attract any patrons. If we end the Welfare State, we end the cause–thus we won’t see the effects that are hurting the economy so much.
This is true because there are state freeloaders that were born here too, not just immigrants, who leach off the state. There are also many hard working immigrants who actually want to work.
How about if we end the welfare state and let the Free Market control the mass immigration? Then, only hard workers would come and our economy would be better, not worse.
