The Obama administration and their allies in the media are celebrating Clinton appointee Susan Bolton’s temporary injunction against SB 1070. I sure hope she gets that 9th Court appointment, she has earned it. The New York Times called it “Warning to Other States.” Some patriots are becoming discouraged.
In reality, SB 1070 is a warning to illegal aliens and their allies in the federal government respect our laws and Americans have reason to celebrate.
As of July 29, Sanctuary/Catch & Release policies in this state are illegal under state law. Citizens, you remember the term, “We The People?” Well, We The People can sue our government for failure to enforce our laws and will and that will be a up to $5,000 per day for any policy that restricts or limits the enforcement our federal law to the full extent permitted by law. State officials are required to report illegal aliens. There are still increased penalties for hiring illegal day laborers.
SB 1070 is already working. CNN reported that even though SB 1070 “now heads for higher courts…some of the estimated 500,000 undocumented immigrants in Arizona are leaving the state.”
Judge Bolton’s temporary injunction against parts of the law is minor setback, but Arizona will fight this in court until we prevail just as we did when a judge issued an injunction against Proposition 200.
The citizens of the United States are standing with Arizona. According to a July 19 Quinnipiac University Poll, Americans oppose the Justice Department’s lawsuit against SB 1070 by a margin of over 2-1 and in another national poll support SB1070 by 66%, again by over 2 to 1.
Most know that illegal immigrants are, well, you know illegal. Barack Obama does not.
The basis of the Justice Department’s complaint is not that SB 1070 interferes with federal immigration law, but rather that it interferes with the Obama administration’s “discretion in enforcing the provisions of the federal immigration laws” that means his priorities of NON enforcement over ours of enforcement.
This discretion means they only will go after illegal aliens who are also “engaged in or suspected of terrorism or espionage; aliens convicted of crimes, with a particular emphasis on violent criminals, felons, and repeat offenders; certain gang members; aliens subject to outstanding criminal warrants; and fugitive aliens, especially those with criminal records.” He means they must commit another crime and have another victim before they will do anything and then maybe. What is another homicide, molestation, home invasion, kidnapping, of job taken from an American bread winner to getting those future votes or the cheap labor the profits over patriotism crowd is demanding.
All this while the Mexican drug wars are flooding across the border into Arizona with home invasions and kidnappings becoming commonplace. Phoenix is the kidnapping capital of America. 15 police officers have been shot or maimed by illegal aliens in Phoenix alone. During the debate over 1070, my friend and 5th Generation Arizona Rancher Rob Krentz was murdered by illegal alien drug dealers. Days after the law passed, a police officer was shot by other illegal alien drug smugglers. I have a son who is a Deputy Sheriff who was shot and critically wounded while serving Homicide warrants on illegal alien suspects.
Illegal immigration also strains the economy of Arizona. The non-partisan Federation for American Immigration Reform recently released a study that found illegal aliens cost Arizona Taxpayers 2.6 billion dollars a year. Before Arizona passed the Legal Arizona Workers Act to keep employers for hiring illegal aliens, 9.8% of our workforce as illegal.
Arizona’s stand against illegal immigration is not just about States’ Rights, it’s about a State’s Responsibility.
When I assumed office, I put my hand on the bible and solemnly swore to “support the Constitution of the United States and the Constitution and laws of the State of Arizona, that I will bear true faith and allegiance to the same and defend them against all enemies, foreign and domestic.”
SB 1070 is the law of the State of Arizona.
Article IV Section 4 of the US Constitution states: “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion.” The flood of illegal aliens—many of whom are terrorists, violent drug dealers, and gang members—is nothing short of an invasion. I swore to protect the Constitution as the founders intended it, not the political agenda of a left wing activist judge and administration.
By siding with lawbreakers and undermining the Democratic will of the American people, I’m tempted to call the Obama and his lackeys domestic enemies. At the very least he is more concerned about what America’s enemies think about SB 1070 than the American people. Obama’s Deputy Secretary of State issued an affidavit against SB 1070. Among his justifications was Venezuela’s outrageous accusation that the law “could lead to the legitimization of racist attitudes and the latent risk of violence.”
That’s right, Obama’s state department is using slander by anti-American Socialist Dictators like Hugo Chavez as an excuse to overturn the democratic process in Arizona!
I do not take my oath of office lightly. It is my duty as a public servant and an American citizen to ensure that SB 1070 is enacted and enforced. The people of Arizona will not rest until this happens.


Art 1 sect 10
“No State shall, without the Consent of Congress, …. engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”
Since the Fed refuse to follow Art 4 Sec 4 and protect us against invasion it’s time for the Governor and State Legislature to truly get spines, utilize their rights under Art 1 Sec 10 and place the Guard on the border now.
Sorry, Russell Pearce has lost his credibility. He’ll say whatever he needs to say at any moment to get the outcome he wants. That’s otherwise known as lying. It’s situational ethics. It doesn’t matter if we agree politically or if I share his views on immigration. He’s just one more lying politician.
On an out of state radio show last week, he said he had 4 legal opinions regarding SB1070 from constitutional scholars who “travel the country teaching classes on the constitution like Eddie Farnsworth and Andy Biggs.” Outrageous made up on the spot ***lies*** for out of staters who don’t know better, just so Pearce can appear to make his point.
It’s still lying. It still makes him a lying politician.

“original jurisdiction” in cases involving States.
It would appear that Judge Susan Bolton not only does not understand, or has ignored the Constitution in this case, but had no business presiding over and picking and choosing what issues involving AZ SB 1070 that she deems “acceptable.”
That said, this State law was written to mirror the Constitution, and what the Feds had “failed miserably” to do (to coin a Dem phrase) in their upholding of the law in protecting it’s borders.
Other states are following Arizona’s example. Oklahoma already has their strong anti-illegal immigrant law in place, but they are not being harassed by the Feds because they are not a border state. It’s high time the States as a whole stand their ground to the Feds before we have another outright “War Between the States.” It will only get worse and extremely difficult to do so if they don’t.
Frankly, all Arizona has done exercise self defense.

The “living document” approach to the Constitution has turned it into a “suicide pact”
The states would be well advised to dust off the Virginia and Kentucky Resolutions of Jefferson and Madison regarding Federal edicts and constitutionally vague laws.

Yes, this is being discussed more and more across the internet. Brewer is named in the suit, and she’s governor, so Article III comes into play.
It’s a protection – checks and balances – against just this sort of political harassment.
It further highlights that our Justice Department is currently led by legal hacks and loyal only to partisan politics.
Mark Levin, president of Landmark Legal Foundation, which has filed an amicus brief in this case, states as follows:
“Federal preemption can be either express or implied: express where the Constitution says so (declaration of war), implied by conflict with federal law. In the immigration context, implied preemption exists only 1) if a statute falls into the narrow category of a “regulation of immigration”; 2) if Congress expressed “the clear and manifest purpose” of completely occupying the field and displacing all state activity; or 3) if the state regulation conflicts with federal laws such that it “stands as an obstacle to the accomplishment of the full purposes and objectives of Congress” (De Canas v. Bica). Federal immigration law does not preempt AZ law, and the authors of the AZ law were well acquainted with the pitfalls they needed to avoid — and avoided them.
I think the word “abomination” does not overstate this court’s decision.”
Mr. Levin appears to be on solid ground, as do Senator Pearce and Governor Brewer. It strikes this writer that AZ would be justified in ignoring the Bolton decision, as it seems to be unconstitutional for her to have ruled against a state and/or its governor.
The feds do not seem to be able to legally sue the state, but they did. The judge cannot legally preside over a suit against the state, but she did. The illegal aliens cannot legally be in our country, but they are.

Senator Pearce is exactly correct-WE are correct in passing and enforcing SB 1070. We are NOT violating the Constitution and we have every right to protect our persons and our possessions! And part of the protecting means eliminating the 2.6 BILLION dollars a year it costs the tax paying citizens to feed, shelter, educate, medicate, and adjudicate the illegal immigrants.
Obama wants to conveniently forget the term “illegal” as we refer to the illegal immigrants. THEY are the ones who have broken our laws, invaded our country and have plundered it! They are the ones who deserve the wrath of our Federal government!
When our Federal government cannot or will not defend the States, then the State have every right to defend it citizens and their property.
And do not ever forget the 15 brave law enforcement officers that have died or been seriously wounded by our illegal invaders. That and the drug cartels recent $1,000,000 bounty of Sheriff Arpaio’s head!
Enough is enough! We want SB 1070 enforced and we DEMAND that the security fence, already extremely effective, be finished across our entire southern border. If our government cannot defend our southern border, we have no need of that government!
Russel Pearce is absolutely right. SB1070 is our defense against the invasion of Illegals who come here to take our jobs, our nationality, our welfare checks etc..not to forget those who come and hurt us. They have the nerve to demonstrate AND MAKE DEMANDS! I have been getting the Arizona Republic for 25 years,and I read always read the letters to the editor because it is in a way the pulse of the state of our State. When the controversy over Illegals started a few years ago, I paid particular attention to the letters sent by Latinos. I have probaly seen hundred of letters whining and using pejorative comments about
Our country. I saw fewer than ten expressing gratitute towards America.
I am very proud of Russel Pearce, he is a true patriot and I, for one, am very very grateful for everything he has done and is doing for us.
P.S: I am a naturalized American who came here legally, and I thank God every day for the privilege of living here.
I wonder when will brave Republicans call out Senator Pearce for what they know in the hearts he is? Sadly it would take but a few but It seems all are cowed by fear.
Ha. Yes, you guys all know more about these constitutional issues that Bolton does. Thats why she is on the bench and you are on the couch, right?
