On my radio program, I regularly spoke with Arizonans about the disastrous effects the proposed, and now passed, health care legislation could have on Arizonans. Had I been serving in the U.S. Senate in December when the Senate voted on this bill, I would have done everything in my power to stop it. Sheriff to Decide on Run for Governor Soon

PHOENIX, AZ – Sheriff Joe Arpaio of Maricopa County continues his record-breaking pace of raising campaign funds for re-election. In just twelve months, Arpaio has raised $2 million from supporters in Arizona and around the country.

“I am deeply humbled and tremendously grateful for the outpouring of support from my constituents and others who support my policies,” said Arpaio.

Arpaio’s campaign manager and architect of the fundraising program, Chad Willems of the Phoenix-based Summit Consulting Group, stated, “The level of support for the Sheriff and his policies is simply staggering. Just when we think it’s going to slow down the contributions just keep pouring in,” said Willems.

“America’s Toughest Sheriff” is still receiving contributions from literally every state in the Union but the vast majority of those are coming from Maricopa County and other counties in Arizona. The campaign announced in January of this year a goal of reaching $1.5 million by March, but easily exceeded that goal by half a million dollars.

Arpaio credits this level of support to his get-tough policies on crime, animal abusers, the operation of his jails, including Tent City, public corruption investigations, and his policies to arrest and detain illegal immigrants and human smugglers.

In recent public opinion surveys, Arpaio’s approval numbers among Arizona voters of all parties poll above 60%. Because of his high approval ratings and ability to raise funds, Arpaio has stated that he is still considering a run for Governor. Recent polls show Arpaio leading all filed candidates and potential candidates in the race for governor by wide margins. A decision on entering the race will be made soon.

Kelly pledges to reverse health care takeover

Jesse Kelly releases the following statement in reaction to last night’s health care vote: “I am deeply disappointed that Representative Giffords has so blatantly voted against the majority of voters in her district. Her vote for a large, new federal health care entitlement will both increase deficit spending and restrict free market health care options available to residents of District 8. When I am in Congress, I will do everything in my power to reverse Obamacare and enact real free market solutions that truly increase competition and lower costs.”

Jesse supports market-based solutions to increase competition. He will work to legalize the purchase of insurance across state lines and permit groups of individuals to pool together to negotiate the terms of their insurance coverage. Moreover, he advocates tax policies that encourage individual ownership of insurance coverage and increased use of health care savings accounts.

Jesse also supports real tort reform that would lower the cost of malpractice coverage through a cap on punitive damages. Tort reform will also lower costs by lessening the practice of defensive medicine.

Dr. Paul Gosar Calls President’s Abortion Deal Unconstitutional

President Should Veto Federal Abortion Funding

FLAGSTAFF – Today, Dr. Paul Gosar called out President Obama for the unconstitutional Executive Order he used as a bargaining tool to persuade Democrats to vote for his national health care legislation.

“It is a disgrace when the President of the United States resorts to unconstitutional acts in order to pass legislation,” said Dr. Paul Gosar. “When his executive order is declared unconstitutional all Members of Congress who voted for nationalized health care, including Ann Kirpatrick, will have voted for federal funding of abortions. I am vehemently opposed to this legislation and the federal funding of abortions.”

Questions have started to surface whether the President can, by executive order, stop a lawfully authorized expenditure program enacted by Congress by an Executive Order. The most constitutional method for a President to strike a piece of legislation is by veto.

“President Obama should simply veto this provision if he truly does not want federal money to be used for abortions,” stated Dr. Paul Gosar.

BACKGROUND ON EXECUTIVE ORDERS

Executive Orders are temporary. The President can sign it today, and revoke it tomorrow. Indeed, upon taking office, President Obama revoked several executive orders signed by President Bush.

More importantly, Presidential Executive Orders have traditionally been used only in time of national emergency, such as President Lincoln’s executive orders shutting down certain newspapers and suspending the right of habeus corpus for prisoners. President Roosevelt used an Executive Order to intern over 100,000 Japanese Americans after Pearl Harbor. Assuming Presidents Lincoln and Roosevelt acted constitutionally (many question whether they did) where is the national emergency here? This is a simple domestic policy issue. There is no war from a foreign country and there is no civil war and there is no emergency. In this circumstance, Article I, Section 1 of the United States Constitution is concise: “All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

So the question remains: Did Congressman Stupak and the other pro-live Democrats get duped? To be constitutional, Presidential Executive Orders have to be enacted pursuant to a provision of the Constitution or pursuant to a Congressional delegation of power, that is, from Congress to the President. Here, Obama’s Executive Order purports to contravene Congressional intent, not further it. Again, the method to stop legislation is by veto, not Executive Order.

The U.S. Supreme Court overruled President Truman’s use of the Executive Order (EO# 10340) in Youngstown Sheet & Tube Co. v. Sawyer, 343 US 579 (1952), whereby President Truman nationalized all the country’s steel mills because that order “made law” as opposed to acting pursuant to law. Here, if Congress authorizes federally paid abortions, how can an Executive Order constitutionally countermand that law? And if it can, why have Congress at all?

Crime Rates Falling in Maricopa County at

More than Twice the National Average

Prison time for felons equals less crime for the Valley

County Attorney Andrew Thomas announced today that the overall crime rate in Maricopa County is dropping an average of 4.8% a year or a total of about 19% between 2004 and 2008.1 Nationally the crime rate is dropping about 2% a year2 or a total of about 8% between 2004 and 2008. This dramatic drop in crime is more than just luck or shifting demographics. It reflects a concerted effort by law enforcement to get criminals off the streets and the determination of prosecutors in the Maricopa County Attorney’s

Office to keep them off the streets.

Between 2007 and 2008:

· The number of homicides fell by 16% in Maricopa County; nationally the number fell by 3.9%

· The number of sexual assaults fell by 6% in Maricopa County; nationally that number is down by 1.6%

· The number of vehicle thefts fell by 23% in Maricopa County; nationally that number fell by 12.7%

Thomas stated, “It would be easy to dismiss the drop in crime rates in Maricopa County as part of a national trend or changing demographics if the reduction reflected the national average. But it doesn’t.

There’s been a dramatic plunge in crime rates in Maricopa County, in large part because the prosecutors in our office work to make sure violent offenders and career criminals are put behind bars. Our prosecution policies make use of the state’s mandatory sentencing laws. Our office enjoys a 94% conviction rate. I hope the legislature stands firm against calls to repeal or water down Arizona’s mandatory sentencing laws.”

The 19% decrease in crime in Maricopa County between 2004 and 2008 translates to:

· 32,000 fewer burglaries3

· 5,500 fewer robberies3

· 9,500 fewer Aggravated Assaults3

Thomas stated, “Police risk their lives to take dangerous criminals off the streets. Our prosecutors keep them off the streets. As a result it’s safer to walk the streets of our neighborhoods.” Taking more criminals off the streets has not slowed down the legal system. In fact the opposite is true. In 2005 it took 79 days to complete a typical felony case from arraignment to verdict or guilty plea. In 2009 that number dropped to 32 days. That’s a 59% decrease. The use of regional court centers and clearly defined plea policies were critical in the decrease. Regional court centers streamline and eliminate

unnecessary hearings and quickly resolve cases when a defendant wishes to plead guilty. The ‘Plead to the Lead’ policy establishes that the County Attorney’s Office will not allow defendants to plea to lesser charges in most serious felony cases, therefore cutting down on haggling and bargaining that at one time clogged the legal system.
