Former Senate President Brenda Burns Files Ballot Petitions Signatures with Secretary of State:
Republican candidate turns in nearly 11,000 signatures; Shows strong support in counties across Arizona

PHOENIX, AZ- Brenda Burns, former Senate President and House Majority Leader, today filed nearly 11,000 petition signatures with the Arizona Secretary of State’s office, furthering her campaign for Corporation Commission, and solidifying her position as a frontrunner for the nomination.

“I am proud of the level of support we’ve shown across the board,” said Burns. “From Maricopa to Yavapai, Coconino to Graham, we’ve shown strength in every county of the state.”

Burns was required to turn in just under 6,000 signatures. Her campaign turned in nearly 11,000—an excess of 80%. None of the other announced candidates for Corporation Commission have turned in their signatures to qualify for the 2010 ballot.

In addition to filing above and beyond the requisite signatures needed to secure a place on the ballot, Burns has also turned in just under 2,000 five-dollar contributions in order to qualify as a Clean Elections candidate. She is only the second state-wide office candidate to turn in qualifying contributions and signatures under Clean Elections this year.

Brenda Burns has a strong record of protecting taxpayers from government waste, and she plans to extend that record to the ratepayers of Arizona as their next Corporation Commissioner.

“The Arizona Corporation Commission deals with many issues that affect our state,” said Burns. “These issues affect the availability, affordability, efficiency, and reliability of providing energy to Arizona consumers.” Burns continued, “The rates it sets and the policies that drive those rates will have an increasingly significant impact on the future of all Arizonans. We need also to increase our focus on combating securities fraud, especially in these economic times. ”

Burns credits her vast network of volunteers for her campaign’s early success. “All the credit goes to our many volunteers across the state,” said Burns. “Without them, this would not have been possible, and I am so grateful.” Burns will still be collecting signatures because the Secretary of State will be accepting supplemental signatures sometime in May. “We want to continue to show support through this method,” said Burns.

On top of turning in all qualifying documents for the ballot and Clean Elections, Burns has received the endorsement of many in the conservative Republican movement in Arizona. Congressman Trent Franks Speaks Out for Life

Today was the annual March for Life here in Arizona. This day was a day to commemorate the millions of precious lives lost and affected by the wanton violence of abortion which breaks the sacred bond between a mother and child.

It has now been 37 years since Roe v. Wade started us down the path of 50 Million lives lost.

Congressman Trent Franks is one of my biggest Pro-Life heroes in the movement and he deserves our thanks for standing many years firm on this issue.

It is not the critic who counts….

It is very easy to armchair quarterback, nit-pick and manipulate a story, then package your message to be appealing.  Anyone can sound good when they pick and choose the topics, script the dialogue, and set their own stage.   It is far more difficult to actually be “the guy”, no choices about who, what, when, or where…you must take on all comers.  Exposure comes when you must deal with real issues and make hard choices that will be subject to criticism by those who have no idea the effort involved or the sacrifice paid and won’t be held accountable for their opinions even when they are promoted as fact.

 This famous speech captures the sentiment well:

John McCain is not perfect nor has he had a perfect career.  That is what is so hard about being human, none of us are.  But, he is the current voice of strength for conservative ideals in the Senate.  Scott Brown made that very clear last week when he singled out Senator John McCain in his acceptance speech.  I find it funny how appreciative conservatives where when they thought his relationship with Lieberman could be used to our benefit, but how quickly some turned it into a sign of defection when it suits a negative attack.   Sarah Palin is everyone’s darling based on her vision and beliefs, unless of course she would dare suggest she supports John McCain’s re-election.  She is either flawed or foolish…but she cannot be right?  

I do not believe this is the time for our energies to be spent on electing a different Republican when we have so much opportunity to elect NEW Republicans in Dem held seats.  I am not dissuaded with the twisted tales, selective snippets, or outright personal attacks.  Do I agree with everything he has ever done or said?  NO.  Is John McCain a bullheaded, hard-nosed, my way or the highway guy?  Probably.  Does he play hardball and expect you to be ready for it or get out of his way?  I think so.  Could it be those very attributes have uniquely placed for the time we are in to be a stalwart of Republican domination of the Democratic efforts?  Definitely!

JD Hayworth Leaves KFYI

You have to live in a cave if you haven’t heard by now that conservative talk show host and former congressman JD Hayworth suddenly announced that this evening’s show would be his last with KFYI.

Hayworth, who is one of the biggest named conservatives in Arizona, also signaled that he would be moving back into public service.

For several months, pol watchers have been speculating whether Senator John McCain would finally meet his match in a Republican Primary. This appears to be right around the corner now without Arizona’s most famous conservative spokesman officially announcing the beginning of a campaign.

Should JD make it official, his entry in the race will reflect the mood of voters across the country as a rising insurgency with the distinct feel of a conservative populism.

Hayworth’s possible challenge to McCain will likely pose a political dilemma to Alaska’s former Governor Sarah Palin who is scheduled to stump here in Arizona for McCain in March. Palin’s Facebook and the Twitter world is buzzing with comments and tweets from supporters begging her to reconsider her support for McCain. Here is a sample:

Dear Executive Committee Members:

It has come to my attention that the Chairman of the Yuma Republican Party, Phil Townsend, has sent a letter to members of the Arizona Republican Party Executive Committee alleging several serious improprieties on the part of myself and Lee Miller, our Legal Counsel.  I felt it was incumbent upon me to respond in kind.

There have been a number of recent inaccurate emails, blogs and reports regarding the financial operations of the AZGOP.  In every instance where I have been contacted by members of the Executive Committee either by phone or email regarding any of these communications, I have responded to their questions as quickly as possible.  Unfortunately, Mr. Townsend, decided he would rather write a letter than get the facts.

The AZGOP files both federal and state reports for various contributions and expenditures at different times depending on the reporting requirements of the FEC and Arizona law.  We have never failed to file nor been fined by the state or FEC for violations under my chairmanship; although, we did pay a fine to the FEC in 2007 for violations that occurred prior to my becoming chairman.  During this time, we have filed numerous amended reports and responded to regular inquires from the FEC on different matters.  Campaign regulations are complex and Byzantine to say the least.

With respect to the RNC transfer of $50,000 that was done late in November of last year, it was not reported in the FEC report filed on December 19th.  By the time I reviewed the report, it was too late to correct it.  Missing a filing date is a serious matter and will result in a fine.  It is better to file and amend later, which is what we are doing.  I have spoken with the RNC about it and they understand we will amend the report.  None of the RNC funds have been “used to pay overhead,” as Mr. Townsend alleges.

With respect to the question regarding debts of the party asked by Donna Reagan during our conference call on December 30th, what I said was we had accounts payables that needed to get paid and I was working on doing that, but we had no debt and I had no intentions to borrow money.  We do have some payables that need to be listed on the FEC report and they will be on the December 31, 2009 report that will be filed at the end of this month.

With respect to Mr. Abate and his letter, he was not provided all of the facts by Mike Hellon or Shiree Verdone, campaign staff for Senator McCain.  Certainly, the bylaws of the party allow the Chairman and Treasurer to assign their check signing authority when necessary.  This does not relieve them from their fiduciary responsibilities to be fully aware and knowledgeable about all expenditures.  This was not what Mr. Hellon and Ms. Verdone were asking for me and Timothy Lee to do.  They demanded control over all Victory Program funds.

At the time they made their demands, there were several people in the room who can confirm what occurred.  I suggest that this be fully aired in our Executive Committee meeting on this coming Saturday afternoon. It is sufficient to say that I had real concerns with their demands; however, I felt it was prudent to check with counsel before deciding what to do with the Victory Program.  In addition to talking to Lee Miller, I took the time to call legal counsel for the RNC, a former commissioner for the FEC, and explain the circumstances.

In both instances, the conclusion was the same.  The AZGOP could not give check signing privileges to campaign staff members of Senator McCain’s campaign.  This would likely be a violation of McCain-Feingold campaign laws.  While it is legal for state parties to coordinate with federal candidates on certain expenditures made by the party on behalf of their campaigns, it is not proper to give control over those efforts and funds to the respective campaigns.

What, I along with the assistances of Legal Counsel, the Treasurer and members of the ad hoc victory committee have done is to establish a framework for review of the Victory Program and to put in place appropriate controls and procedures to assure we will not have legal problems with the implementation of the Victory Program in 2010.  If anyone would like more detailed information on our financial reports, they are available on the FEC website as well as the Secretary of State’s website.  If you have trouble navigating either site, please call Brett Mecum at our office and he will help you get the information you need.

Pay attention: In the afterglow of the Massachusetts Miracle, there are flickers of peril for the right. I hate to be the bearer of bad news, but like Paul Revere’s midnight message, consider this warning “a cry of defiance, and not of fear.” Conservatives have worked hard to rebuild after Big Government Republican John McCain’s defeat. But McCain isn’t going gently into that good night.

No, good readers, John McCain isn’t going gently into the night.

This coming Saturday, apparently, his operators are going to attempt to unseat the state party chairman and RNC treasurer, according to some, because the GOP state party executive committee refused to approve his version of the 2010 GOP Victory Plan.

Now, there are allegations his operatives have floated to liberal online rags like the Arizona Guardian, that the state party chairman has engaged in deceptive accounting.  Of course, there is no proof of this, just iterative reference to other allegations made.

Their new shtick is to “just show us the bank statements”.  However, according to one astute comment (#27) made under this SA blog post , an officer of a corporation may not disclose legally privileged corporate documents unless otherwise required to by law or the rules of the corporation.

What does that say about people who ask an officer of the corporation they claim to support to legally betray that corporation?

Not to wander too far off the point of this post, back to Malkin in her article today…

Perhaps it’s time for Senator McCain to retire with whatever grace he has left and leave the reins to younger up and coming Arizona Republicans.

I’m beginning to believe that it’s not all the senator’s fault.  The “McCain machine” in Arizona has been around for so long and has so many lackey consultants, staffers and former staffer-hangers on who rely on his machine for their paychecks, that he will not go softly into the night and that the price we are going to pay is the McCain-driven (perhaps not by him personally, but who knows?) destruction of the Arizona Republican Party.

Federal Election Commission Questions McCain Campaign Finance Reporting

Searching on McCain at  http://www.fec.gov/finance/disclosure/imaging_info.shtml yields the following information:

This committee, McCain’s candidates campaign finance committee,

failed to report complete financials for 2Q09  and 3Q09.

They omitted information required BY LAW and were forced to file amended reports several months later!

What are Republicans going to do about this?  There are many questions.

Currently, John McCain operatives such as Shiree Verdone and the county Chairman of Yuma county are trying to usurp the Arizona State Republican Party chairmanship position based the very same and similar accusations they are making themselves and via strawmen against the Chairman.

Ironically, their own boss has unfortunately engaged in almost precisely the very same thing!

Is that not ironic?  Is that not inconsistent?  These McCain operatives support the behavior when they do it, but oppose the behavior when their opponents do it.

Sounds more like Senator Al Gore then Senator John McCain.  Is there a difference these days?

Who should control the AZ GOP’s Get Out The Vote Effort?

As discussed in a previous post, there is a fight brewing for the State GOP Mandatory Meeting this Saturday. Opponents of State Party Chairman Randy Pullen are trying to characterize this fight as an attempt to expose Randy Pullen’s alleged financial mismanagement of the party. This is BS. Let’s all get aboard the Straight Talk Express and have an honest discussion about what this fight is really about. This is a fight over control of the state party’s GOTV effort and money (i.e., the Victory funds) and, more generally, control of the state Republican Party.

Specifically, Randy Pullen and the State Party want to retain control over the money and John McCain and his allies want to control the Victory funds. That is, John McCain wants one of his staffers or one of the staffers of John Kyl to have exclusive authority to authorize all spending of Victory funds. Randy Pullen wants the state party to retain spending authority of the Victory funds and not have to ask permission from our Senators’ staffs to spend Victory funds. The stories (or hit pieces) about Randy Pullen’s alleged financial mismanagement only began to appear after Randy Pullen orchestrated the Az GOP executive committee’s rejection of the 2010 GOTV plan that gave McCain control over the Victory funds.

It seems to this blogger that John McCain and his staff should not have any control of the Victory funds or control the State Party’s GOTV effort because a conflict-of-interest exists. The purpose of the Victory funds and the State Party is to drive Republican turnout and elect as many Republicans as possible. This year, John McCain is just another Republican candidate with primary opponents (and a potentially primary-losing candidate if JD Haworth enters the US Senate race).

Giving McCain’s staff control over Victory Funds creates a potential situation where Victory Funds could be misused to benefit McCain and to the detriment to all other Republican candidates. For example, McCain’s staffer could decide to allocate funds to drive turnout of voters who will vote for McCain but no other Republicans. In another example, funds could be allocated to make robocalls that promote McCain instead of other GOP candidates (e.g., the GOP gubernatorial candidate or our congressional candidates). With McCain’s staffers having absolute control over the allocation of funds, there is nothing anybody could do to stop this abuse of power.

Because of this inherent conflict-of-interest, no candidate or his staff should be given control over allocation of Victory funds or the GOTV effort. The State Party should control GOTV efforts and the Victory funds for the benefit of all GOP candidates, as is traditionally the case. Hopefully Saturday, we can have some straight talk about control of the GOTV efforts and money instead of an disingenuous fight about some side issue.

 

Goldwater Institute asks Judge to Find Glendale in Contempt of Court

PHOENIX–After four months of inaction and waiting for the City of Glendale to comply with multiple judge’s orders to promptly produce public records relating to negotiations between city officials and owners of the Coyotes hockey team, today the Goldwater Institute asked the judge to find the city in contempt of court.

In June, the Goldwater Institute Scharf-Norton Center for Constitutional Litigation filed a public records request with the City of Glendale after media reports surfaced indicating that city officials were planning to offer illegal subsides to potential bidders on the bankrupt Coyotes hockey franchise in an attempt to keep the team playing in Glendale. 

When Glendale officials refused to comply with the records request, the Goldwater Institute took the city to court. In July, Maricopa County Superior Court Judge Edward O. Burke ordered the city to turn over to the court any records generated by negotiations on an ongoing basis. Then the court would decide which records were too sensitive to be made public, which was the city’s argument against releasing the documents.

Glendale has not submitted any records since September 16, 2009 despite highly publicized negotiations with interim owner, the National Hockey League, and future owner Ice Edge Holdings about a lease agreement for the team to keep playing in the city-owned Jobing.com arena.

“Glendale’s actions represent a lack of respect for the court and the law,” said Carrie Ann Sitren a Goldwater Institute attorney. “In addition to wasting taxpayer money on a bankrupt hockey team, the city government is thumbing its nose at its obligation to keep its citizens informed. Clearly, stern action is warranted.”

Judge Burke has ordered Glendale to comply with Goldwater’s public records request on four separate occasions. In addition to finding the city in contempt, the Goldwater Institute would like the judge to set a schedule for producing records that the city must follow.

Mayor Elaine Scruggs, who represents Brewer’s home town, has been a longtime supporter of the Governor. “Governor Brewer has fought to help the state fix its own financial problems, without balancing the state’s budget on the backs of the cities and towns,” she said.

Mayor Bob Walkup served on Brewer’s Transition Team last year and commended her on her leadership in these difficult times, “Brewer took the helm as Governor a little more than a year ago in the midst of Arizona’s record financial crisis. She pledged to make the tough choices and while serving the people of Arizona – and she has done just that.”

Mayor Scott Smith commended Brewer on her ability to balance fiscally responsible cuts with a desire ensure Arizona’s long-term economic viability. He explained, “Governor Brewer understands that while the state must live within its means, we must make sure we are taking care of the core services that Arizona must provide.     Judge Strikes Down Matching Funds Portion of Clean Elections

    Phoenix—Today U.S. District Court Judge Roslyn Silver ruled in favor of the Goldwater Institute and permanently struck down the matching funds provision of the Clean Elections law. Judge Silver gave the state five days to appeal the decision and seek further relief in the 9th Circuit Court of Appeals before the judgment becomes enforceable.

    In the 23 page decision, Judge Silver ruled, “The Act, in its current form, is not supported by a compelling interest, is not narrowly tailored, and is not the least restrictive alternative.  The Act is unconstitutional under the First Amendment.”

    “We hope the State will not appeal the injunction,” said Goldwater Institute attorney Nick Dranias. “All along, the State has said the candidates need certainty, and they do. The system is unconstitutional and it’s time for the state to protect free speech and follow the law.”

    The Goldwater Institute filed suit against Clean Elections in August 2008, arguing the matching funds provision violates the free speech rights of traditionally funded candidates by causing their campaign contributions and expenditures to trigger government subsidies to opposing publicly-funded candidates.
