There is no question about there residency in this state.  It is absolutely true that these students cross the international border every school day at the Lukeville Port of Entry, get on a Ajo school district bus, and go to school in Ajo, AZ.  They may very well be U.S. citizens, but they do not live in the state of Arizona.  They are also eligible for the same services that legal state residents are receiving.</description>

<p>There is no question about there residency in this state. 		<description>This has been going on for years, and there is no possible way the educators in Ajo can say that they didn&#039;t know.  I personally know several teachers/parents who have voiced concern and discontent regarding this issue only to have higher-ups ignore the them.  I have seen these kids getting on and off the Ajo school buses countless times over the last few years.  How can the superintendent of schools for the Ajo school district say he didn&#039;t know?  He&#039;s either a real bad liar or plain stupid, both are good reasons for immediate termination.</description>

		<description>I agree with Klute that this is a an attempt by Horne to get some traction with conservatives. Seems pretty hopeless.

To the actual issue, Horne, and undoubtedly most on here, are assuming that these kids do not have a parent who is an AZ resident. When a similar issues have arisen elsewhere it has not been the case that even most of the students seen crossing the border do not have a legal guardian residing in the US. 

Horne also misstates what in fact has happened. The Pima county attorney has ruled that the request from Tom Horne violates FERPA. I am glad they are watching out for the students attending their schools and will fight to make sure they don&#039;t become Horne&#039;s scapegoats on his way to the AG&#039;s office. 

What is even more funny is in the correspondence to the district, Horne&#039;s office claims they have a right to the information under FERPA and then cite parts of the code which have nothing to do with this situation and in fact in at least one case has to do with higher education. Doesn&#039;t seem like a good candidate for AG if he can&#039;t even get the law right.</description>
