Napolitano says illegal border crossing isn’t a crime; Sen. Sessions demands correction

Napolitano said the following during an interview with Larry King:

And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.

This is wrong because crossing the border illegally is a criminal misdemeanor. 8 USC Sec. 1325(a) says that crossing the border illegally is punishable by up to six months in prison for the first offense. Ranking Member of the Senate Judiciary Committee Jeff Sessions is demanding a public correction of her statement.

It is breathtaking that a cabinet secretary, bestowed by the public with the responsibility to protect our nation’s borders, could be ignorant of the undisputable fact that it is a violation of the criminal code to enter our country illegally. 8 U.S.C. 1325(a), which has been in effect for decades and codified in its current form since 1991, is unambiguous that doing so is a crime. This is one of the most baffling statements from a high government official I have ever heard. …

… Sec. Napolitano must swiftly, clearly, and unambiguously correct her comments on this matter to set the record straight.

It is frustrating to those of us in Arizona who have watched Napolitano’s record of incompetence for years, elected only due to the liberal media, not any kind of an impressive record. She is frankly an embarrassment to those of us in Arizona now she’s at the national level.

Excessive English Language Learner requirements implemented under Napolitano’s legal representation

By now, you’ve all heard of Flores v. Arizona, which is currently being heard by the U.S. Supreme Court. It is a lawsuit brought in 1992 by the parents of Spanish-speaking children in Nogales, AZ, alleging that their civil rights were violated because the state wasn’t providing adequate education for their language difficulties (note – this lawsuit has been a sore spot because no doubt a large percentage of these students are illegal immigrants or the children of illegal immigrants, and funding illegal immigrants has contributed to the state’s economic crisis). The lawsuit was filed against the state – namely the Superintendent of Public Instruction, who was represented by the Attorney General’s Office.

In 2000, federal district court judge Alfredo Marquez, known for being an activist left wing judge, ruled that there was not enough funding. Instead of appealing the decision, the state worked out terms of a consent decree with the plaintiffs that required ALL of Arizona’s – not just Nogales where there are a higher level of Spanish-speakers – to implement a high level of school programs (requiring a higher level of funding) for Spanish-speaking students. The AZ Department of Education produced a cost analysis shortly afterwards predicting the cost of these programs would cost up to $4,600 per ELL student.

Since then, the state legislature has tried repeatedly to increase funding for ELL. Unfortunately, Judge Marquez continues to rule that the additional funding isn’t enough. We wonder how much Arizona has spent on this issue since the lawsuit was originally initiated in 1992. Washington Legal Foundation characterizes it as one federal district court judge usurping the role of the legislature and running Arizona’s school policy for years. The law doesn’t define what “appropriate” education means, Marquez should be deciding cases based on what the law says, not how he decides to define it. Currently, Arizona spends $430 extra per year on each ELL student – still not enough for Judge Marquez, who has threatened to put legislative leaders in jail! Judge Raner Collins has since taken over the case, following in the footsteps of Judge Marquez against the state.

Clearly, Napolitano did a poor job representing the state as Attorney General in this lawsuit. The onerous terms of the consent decree, which then-Superintendent of Schools Lisa Graham Keegan signed on behalf of the state in 2000, should have NEVER forced these excessive requirements on other cities and towns around Arizona. The decision should have been appealed in 2000. Thanks, Napolitano, during these times of economic crisis, your legacy lives on.

Tonight there is violence in our streets, corruption in our highest offices, aimlessness among our youth, anxiety among our elders and there is a virtual despair among the many who look beyond material success for the inner meaning of their lives. Where examples of morality should be set, the opposite is seen. Small men, seeking great wealth or power, have too often and too long turned even the highest levels of public service into mere personal opportunity.

We see this as the result of a fundamentally and absolutely wrong view of man, his nature and his destiny. Those who seek to live your lives for you, to take your liberties in return for relieving you of yours, those who elevate the state and downgrade the citizen must see ultimately a world in which earthly power can be substituted for divine will, and this Nation was founded upon the rejection of that notion and upon the acceptance of God as the author of freedom.

Those who seek absolute power, even though they seek it to do what they regard as good, are simply demanding the right to enforce their own version of heaven on earth. And let me remind you, they are the very ones who always create the most hellish tyrannies. Absolute power does corrupt, and those who seek it must be suspect and must be opposed. Their mistaken course stems from false notions of equality, ladies and gentlemen. Equality, rightly understood, as our founding fathers understood it, leads to liberty and to the emancipation of creative differences. Wrongly understood, as it has been so tragically in our time, it leads first to conformity and then to despotism.

Fellow Republicans, it is the cause of Republicanism to resist concentrations of power, private or public, which enforce such conformity and inflict such despotism. It is the cause of Republicanism to ensure that power remains in the hands of the people.

I know that the road to freedom is a long and a challenging road. I know also that some men may walk away from it, that some men resist challenge, accepting the false security of governmental paternalism.

I cherish a day when our children once again will restore as heroes the sort of men and women who – unafraid and undaunted – pursue the truth, strive to cure disease, subdue and make fruitful our natural environment and produce the inventive engines of production, science, and technology.

We Republicans see in our constitutional form of government the great framework which assures the orderly but dynamic fulfillment of the whole man, and we see the whole man as the great reason for instituting orderly government in the first place.

We see, in private property and in economy based upon and fostering private property, the one way to make government a durable ally of the whole man, rather than his determined enemy. We see in the sanctity of private property the only durable foundation for constitutional government in a free society. And beyond that, we see, in cherished diversity of ways, diversity of thoughts, of motives and accomplishments. We do not seek to lead anyone’s life for him – we seek only to secure his rights and to guarantee him opportunity to strive, with government performing only those needed and constitutionally sanctioned tasks which cannot otherwise be performed.

We Republicans seek a government that attends to its inherent responsibilities of maintaining a stable monetary and fiscal climate, encouraging a free and a competitive economy and enforcing law and order. Thus do we seek inventiveness, diversity, and creativity within a stable order, for we Republicans define government’s role where needed at many, many levels, preferably through the one closest to the people involved.

This Party, its good people, and its unquestionable devotion to freedom, will not fulfill the purposes of this campaign which we launch here now until our cause has won the day, inspired the world, and shown the way to a tomorrow worthy of all our yesteryears.

I thought, at this juncture in our history, we might review and reflect the vision and thoughts of a true Conservative.  No, this isn’t original or witty, it isn’t supposed to be.  When someone posts or asserts “I’m a Republican” or, “I’m a conservative, but…”  perhaps these thoughts will echo in our thoughts and we’ll once again find that great vision of a great man.  I am not a fan of the “Big Tent” and, I doubt Senator Goldwater would be either.  We as conservatives and Republicans have values and standards.    When faced with the issues and challenges today, lets ask the question:  How would Barry evaluate this issue?

Chris Simcox to Challenge John McCain

It’s official. Senator John McCain will have a Republican challenger next fall.

Tomorrow, conservative border security activist, Chris Simcox, will announce his bid for the US Senate seat currently held by John McCain. Simcox will make his announcement on the State Capitol lawn at 11:30 and will likely be surrounded by supporters and those angry with Senator John McCain.

This undoubtedly will set the stage for what will be a fight for the soul of the Republican party here in Arizona.

Over the years, many believe John McCain has abandoned the party’s conservative principles on the issues of free speech, sanctity of life, national security and immigration enforcement. Simcox’s conservative grassroots background and position on such issues is certain to pose a credible if not uncomfortable challenge to McCain.

Simcox is also expected to garnish widespread support not just here in Arizona but amongst other supporters across the Southwest. He is expected to call upon these supporters to help raise money especially during a time when drug cartels are expanding their terror campaigns across the border. 

While McCain supporters will attempt to brush off Simcox’s challenge as less than credible, those close to McCain’s inner circle will eventually have to admit that they have a real problem.

The Real Winner of Miss USA

Long after the 2009 Miss USA contest is over, everyone will remember the real winner of the Miss USA contest, Miss California, Carrie Prejean.

She was denied the crown because she spoke her values, faith, character and committment to traditional marriage.

The BGLT community should be ashamed of itself and unfortunately, will experience a backlash against bigots like “Perez Hilton.”

GLBT individuals comprise less than 10% of the adult US population.  Of that 10%, less than 25% actually support what has come to be known as “Gay Marriage”.  This overall lack of interest within a minority segment of the population has been the frequent subject of Gay activists lamentations for years now.  It seems however, that one activist, Mr. Lavandeira (aka Perez Hilton) cannot reisist inserting his politics into an apolitical event, the Miss USA competition.

A couple of questions came to mind when I viewed this video of Mr. Lavandeira:  Is this what we can expect from Megan McCain’s “Progressive Republicanism”?  Is this what John Shadegg has in mind when he speaks of “the Big Tent”?  Is Mr. Lavandeira a tolerant man?  Is he representative of GLBT activism?

Tolerance is defined as: the act or capacity of enduring; endurance.

Here’s my question, shouldn’t tolerance be a two way street?  It seems to me, that when tolerance is demanded and not offered it becomes something more sinister, tyranny.

Perhaps when a minority within a minority can demand and command a nations attention, its time to rethink the question, what is tolerance and how far does it extend?

The Canada Free Press is citing one FBI source who is strongly suggesting that those who attended the recent Tea Party may now be semi-celebrities on law enforcement surveillance video tapes.

The second citation provided above is the other side’s story of protest surveillance, those who have been protesting the World Bank, the IMF for years now.  I liked the second story particularly because it was written at the dawn of the second Bush administration.

Keep in mind, Janet Reno was Janet Napolitano’s mentor when Nappy served in the US Justice Department.  Their relationship is well documented.  So we have an idea of what to expect under Nappy’s reign at Homeland Security.  I know for a fact that the MMCDC was infiltrated by the SPLC who provided information on the Border Watch to a government agency.  Yeah, the old folks in lawn chairs sitting on the border in 2004 were the subject of government surveillance.

My point is, rather than sniping at each other as in the cartoon Spy versus Spy, both sides of the political spectrum should be carefully looking at the emergence of a very paranoid centralized government with legal powers not seen in North America since before the founding of our country.

Perhaps those “hidden hands of power” have perfected the illusion of Republican versus Democrat to the point that most Americans view their governance as yet another sporting event.

Could it be that, as the title of Larry Elder’s book suggests, there’s only a dimes worth of difference between either major political party?  Rather, those holding power have utilized the dialectic to herd an inattentive populace into fascism with a happy face?

Perhaps this is what’s behind the government’s paranoia; the people might wake up.  Consider that since at least the Jimmy Carter Administration, fear has been the means of motivation behind many calls for “Change”.

Maybe both sides now should look at their common ground, step out of the sporting event dialectic and as Toto did in the Wizard of Oz, pull back the curtain behind which our nation’s leaders are hiding.


Was Janet Napolitano Right?

This post may provoke some heated discussion so here goes…

If you’ve read the news today, you know that some *$%@#* drove by a photo radar van on the north 101 and shot and killed the Red Flex operator in the van. Many of us disagree with photo radar but that disagreement does NOT justify some *$%@#* to take to the street and express that anger.

We also know that Janet Napolitano is largely responsible for placing these photo radar vans along the highway.

What really bothers me is that Napolitano made the statement just last week about domestic terrorists and some *$%@#* has now gone out and given her report credibility or am I missing something?

Challenge to Congress- Step Up and Fight for Us and Follow the Money

“We try to use as light a touch as we can. But I am not going to simply put taxpayer money into a black hole, where you are not going to see results,” Obama said, according to Reuters, April 19, 2009

The Obama Administration’s promise deserves respect, and specific expectations by the taxpayer.  Those that protested on April 15, 2009, owe it to each other to keep an eye on the bail-out ball.  Follow that money, but also ask for accountability, and define what each of us is willing to tolerate.

Since much funding is set aside through TARP and not all moving about yet; more programs, bank stress tests, and sweeping powers of the Treasury Department, let us help the Administration do it all well.  I am not a savvy bill writing lawyer, but I know that any appropriations bill written and passed is open to change.  New legislation can supplant old as we are seeing everyday with the bail-outs.  Every Tea Party in the United States noted the need for the average citizen to pay attention, get involved, and LEARN.

I am asking our legislators to go back to Washington D.C., and rewrite history. Get the money flowing out to the people or change the rules and stop it all.  Either stimulate the economy directly like you all said you would last fall, or stop the criminal activity now.  There’s got to be a way to file injunctions to stop money from moving anywhere until we look at Goldman Sachs and AIG and all other hedging and credit default insuring, and now said money laundering of fake profits by banks.  No more money funneled to fraudulent banks and insurance corporations.

John Shadegg is my representative.  I like him, I voted for him, and I am asking him to be Mr. Smith. Go to Washington and shake the tree, knock out all of the fruits, and get me the truth. I want the truth and I can handle it.

POINTS OF ORDER

1)   Immediately ask for a Congressional review, with the direct help of the Securities and Exchange Commission (SEC) regarding the highly suspicious use of ‘side letters” during the entire AIG, Goldman Sachs, banking and hedge fund implosion.  Side letters amount to preferential treatment, but they are SO MUCH more. Track the crooked formulas of insuring mortgage backed securities and look at who was saying what.  What memos are out there, who KNEW of this phony swapping, and what whistle blowers are being ignored?

     The SEC is notorious for sitting on information; they did it with Bernie Madoff, and ENRON.  Get some really smart lawyers and CPAS to do what I did over the last few months READ- Like the good film/book -Seven Days of the Condor (three days in the film)  I can tell you this stuff does not add up.

     Do you remember in the movie A Few Good Men, the entire story was about a command given that was truly a set-aside command.  The implied command was to do the opposite.  It was seen as a criminal act, and it was very hard to prove.  I submit, there is a Watergate-level  debacle right in the desk drawers of AIG and the hedge funds. Also, the International Monetary Fund and the Central Banks are playing fast and loose. This is more than one administration deep too. It is being done with our money.  How did all of these banks last week show instant profits?  Why is gold moving around Europe like proverbial salami in hiding?  (Please see past post regarding this: http://sonoranalliance.com/?p=4031)

 

2)      DO NOT give any more money to the banks, but offer a new bill of the stimulus re-write or addendum with a bail-out going directly to 401Ks.  The President told us this stimulus was for responsible people and we all questioned how you’d be able to pick out the good guys.  Well in terms of economics, the good guys save money. The savers put it away for the future, and the money moves around pumping up the economy. Everybody benefits from solvent and strong 401Ks.   Give the savers back the losses.  It’s really easy to find the amounts and the amounts will cost less than handing more funds to shaky banks, or creating completely crooked mortgage bail-outs to those already in dire straits. The majority of those receiving any foreclosure reprieve, end up defaulting anyway. No one wins with mortgage bail-outs. 

     Bail out the 401Ks and the money goes right into the system while supporting the average man’s wallet.  Let’s face it, the banks are NOT stopping foreclosures, and the credit debt ratios of families are going up.  Meanwhile some couples in their 60s,  are trying to get jobs at Starbucks, or seeing no hope, are debating how to hang themselves and still make sure a family member collect the insurance money.  Needless to say, the insurance companies will probably fold before it all goes down anyway!

3) Get a united group of like-minded Congressmen (women) and start the media blitzkrieg.  ‘We are proposing these things, we are putting together concise documentation of the proposals, we are putting them up at this website, and we ask EVERY AMERICAN that attended a tea party or feels victimized by the crushing debt and family strife, to read these proposals, send a letter to your representative and to the President.  We will change this process today and turn the tables.’  Even if your legislation goes down in defeat, get some congressional review generated immediately of the crooked actions of the credit default swaps.  They may have killed capitalism, on your watch, and you did not try to stop it. 

Do you all want to be voted out in 2010? Well then sit back and look lost.  Do you really believe in the principles you put forth those 15 years ago, the Contract you made with all of us in America that said you respected us?  Prove it.  I believe in you, now do not let me down.  If this mini-van driving soccer mom can see the financial crime and little bits of the trails from my desk, reading LOTS of websites and filtering through material. Why can’t you?

You cannot lift the wage earner up by pulling the wage payer down. You cannot further the brotherhood of man by inciting class hatred. You cannot build character and courage by taking away people’s initiative and independence. You cannot help people permanently by doing for them, what they could and should do for themselves.”

Left wing blog speculating on who will run in GOP gubernatorial primary

Blog for Arizona has a rather biased post listing potential GOP candidates for governor in 2010. We like how he refers to the conservative right of the GOP as “RINOs.” From a left wing perspective, I guess that makes sense. We’ve heard from inside sources that Brewer is not planning on running again, so it will be an open primary. Am told she knew when she advocated for a tax increase that she would no longer have a chance at winning election in 2010, which she was fine with, she didn’t intend on running.

Weak Knee’dness Invites Challengers

It looks like there are a handful of Republicans who were’nt paying attention to what happened this last Wednesday.

As many of you know I am now working with the Arizona Chapter of Americans for Prosperity as their Grassroots Coordinator. Working for a strong taxpayer advocacy organization like AFP I am privy to what is going on at the Legislature and in particular the budget process.

As “Chewie” reported in an earlier post, there are a new handful of legislators who may be conspiring with Democrats AGAINST the best interest of YOU the taxpayers. The list includes the following names:

Perhaps these Republicans have forgotten what happened last election cycle when a number of former Republican legislators lost primary elections to strong fiscal conservatives after they buddied up with then Governor Napolitano – who is responsible for the current economic crisis we find ourselves in. Those former legislators ultimately got “fired” by the voters because they didn’t do their job.

I would not be surprised to see a number of challengers arise to these Republicans if they go along with Democrats to raise our taxes.

Heck, since I live in Rich Crandall’s district, I might even dust off my campaign materials, re-open my campaign committee and get back in the battle. We’ll be watching…

Shadegg Shovels the Manure

Recently Mr Shadegg, once the darling of the Conservative image of an Arizonan, expressed some thoughts about the state of his own political party.  Lets walk through some of his remarks as reported by GOPUSA (shown in quotes).

According to John Shadegg, the problems Republicans have is due to their failure to live up to what they promised with the Contract with America. He said that once Republicans took control of Congress, many were corrupted by their power as members of the majority.

Self disclosure is a good thing Mr. Shadegg, shows your emoting with your audience.  How about stepping down and honoring your part of the Contract with America?

Mr Shadegg continues to opine …

Unfortunately, they [himself] were vastly outnumbered by other Republicans in Congress who had been in Congress previously.   Many of those people did not have any strong ideological commitment to any political belief since, as members of the minority, they never had to seriously think of any principles relating to the proper role of government.

Could Mr Shadegg be speaking of Senator’s Kyl and McCain?  It certainly sounds like he’s speaking of those honorable Senators who place reelection as the highest of life’s callings.

However, as the representatives with the most seniority, they took many leadership positions.

What positions could those have been?  Is this john saying that the other two johns might need cleaning?  Lets continue reading …

He [Shadegg] said that getting involved in the Arizona State Republican Party or the Maricopa County Republican Party was a bad idea because they were being poorly led and were at the lowest level since Ev Mecham was governor of Arizona.

Looks like Shadegg fired a broadside on the orders of Admiral’s McCain and Kyl against a state party that no longer bows to their dictates.

You see, its the Delegation’s position that the AzGOP represents them.  They expect the state party to represent them when gathering signatures, fund raising, and turning out the voters.

What they don’t seem understand anymore is that they were elected to represent us.

For example; when Minister Napolitano’s Homeland Security Department reported that Vets returning from Iraq, Pro-Life folks, and Americans concerned about Borders & Immigration might be persons capable of domestic terrorism, Mr Shadegg, Mr Kyl and Mr McCain remained silent.  That silence was deafening.

Seems Mr. Shadegg is working to soften up the immigration and borders issue to clear the beach for the Obama Administration’s attempt to breech the Amnesty and Open Borders Issue – and with the full support of Arizona Senior Senate Delegation.

How can this be determined?  Timing.  In politics just as in business, its all about timing.  Didn’t the Commander-in-Cheat recently put Immigration at the top of his pile on his trip to Mexico?

Now carefully watch the slight of hand:  Shadegg begins his remarks by telling us that Republicans in leadership, ‘” … did not have any strong ideological commitment to any political belief”. Now observe where his logic takes us …

He [Shadegg] said that the Arizona and Maricopa County Republican leaders used the illegal immigration issue to create conflicts in the Republican Party. Instead, he said the Republican Party leaders should focus on having a big tent to welcome many people into the Republican Party.

Whatever happened to any strong ideological commitment to any political belief?  Is Mr Shadegg suggesting that the Party’s platform on Immigration and Borders be a circus under the Big Top?  Or is he talking about inclusiveness like Meghan McCain at the Log Cabin Republican fete?

Our borders and immigration laws mean nothing to these three johns.  Mr. Shadegg has become one of those men he criticized in his opening remarks.

In his desire to ascend to the lofty heights of Jon Kyl’s shoes in 2012, he has chosen to add yet one more Porta-John to the list of Arizona’s outhouses that need cleaning.

Yes, something stinks in Arizona … and its coming from Washington DC.  Its time to flush the johns.
